Understanding Public Procurement Processes in Maharashtra

The public Procurement process refers to a structured and regulated framework designed by the state government to acquire goods and services. Governed by Maharashtra Transparency in Public Procurement Act (MTPPA), these processes are aimed to promote transparency, efficiency, and fairness in government purchasing. 

Below, we've defined Maharashtra's public procurement process within six simple stages. 

Stage 1: Planning and Administrative Approval 

The Procurement plans to issue tender when determining a specified need for goods, services, and works. However, to issue tender opportunities, the concerned authorities have to get administrative approval to ensure that the project aligns with the budget, organizational goals, and strategic priorities. 

Stage 2: Tender Notification & Advertisement 

Once the Tender Inviting Authority gets approval, they may publish a tender on the Maharashtra e-Procurement Portal, Government e-Marketplace, News Paper, and other public media channels to make a wide number of potential bidders aware of the opportunity. 

The Tender Inviting Authority may also need to prepare and attach a tender document, which outlines detailed information about the project, including the scope of work, specifications, and eligibility criteria. This document helps tenders to understand the project expectations. 

Stage 3: Bid Submission and Evaluation 

At this stage, interested tenderers must submit technical and financial proposals while ensuring they meet specified requirements and deadlines. 

Authorities primarily assess technical proposals to check on necessary qualifications, experience, and compliance with project requirements. 

Once the tenderer passes the technical criteria, authorities check them through financial evaluation and assess their bids on the basis of cost, quality, and other criteria. It should ensure the authorities gain the best value in exchange for public funds. 

Stage 4: Negotiations & Award Contract 

After selecting the qualified bidder, both the tenderer and the concerned authority mutually negotiate and agree to the final terms and conditions that involve pricing, delivery timelines, and any other expectations. 

Once the negotiation is done, authorities award a contract to the winning bidder and sign a legal contract that outlines obligations for both parties, performance metrics, penalties for non-compliance, and many other terms governing the execution of the project. 

Stage 5: Deposit Performance Security 

The winning bidder must also deposit performance security against contract breaches, delays, and failures in performance. It may be in the form of a bank guarantee or cash, which is generally refunded after the successful completion of the project. 

Stage 6: Contract Management & Final Payment 

Procurement authorities closely monitor the project to track progress, quality control, and deadlines while ensuring that the project remains within budget. Once the tenderer delivers all the work, a final inspection is made by the procuring authority. Later, they also release the final payment to the tenderer.

  • Orders for removing a firm from the list of approved suppliers should be communicated simultaneously with the reasons. It is, however, not required to provide firms with an opportunity to showcase cause against the proposed action. 
  • The Procurement Office has the right to cancel the procurement process before or even after the acceptance of a successful tender by providing valid reasons in writing. 
  • During the pre-solicitation phase, suppliers must not get access to any privileged information on a particular acquisition before the information is available to the public. 
  • Any individual having a personal or financial interest in a supplier responding to solicitation shall be prohibited from any involvement in the procurement process. 
  • The purchase process in Procurement must be fair, integral, transparent, and equitable for all suppliers. 
  • If anyone intentionally makes any vexatious, frivolous, or malicious complaint with an intention to delay or defeat any procurement or cause loss to the procuring office, they may face legal offense by the procuring office or tenderer. 
  • According to facilities given with an order dated 23-03-2012, the Ministry of Micro, Small, & Medium Enterprises of Central Government has created a specified list of 241 products, whose tender can only be participated by Micro, Small, and Medium Enterprises or Maharashtra State Small Industries Development Corporation.

  • The minimum duration of publicity for the tender varies according to the tender value. 

1. For tenders valued ₹3 lakh to ₹50 lakh: 15 days for the first call, 10 days for the second call, and 7 days for the third call 

2. For tender value ₹50 lakh to ₹25 crore: 25 days for the first call, 15 days for the second call, 10 days for the third call 

3. For tenders value ₹25 crores to ₹100 crores: 25 days for the first call, 25 days for the second call, and 15 days for the third call 

4. For tenders valued ₹100 crores and above (FIDIC/SBD): 25 days for the first call, 25 days for the second call, 15 days for the third call 

  • Tenders for works costing up to ₹15 Crore must be invited on the B-1 (Percentage Rate) form. 
  • Tenders for works costing more than ₹15 crore must be invited in SBD (Standard Bidding Document) format. 
  • Tenders for building works costing more than ₹50 crore must be called on an EPC basis. 
  • Executive Engineer entails the power of approval of the Draft Tender for tenders costing up to ₹1 Crore.  Superintendent Engineer entails power of approval of the Draft Tender for tenders costing more than ₹1 Crore and up to ₹2.5 Crore. Chief Engineer entails the power of approval of the Draft Tender for all tenders costing above ₹2.5 Crore. 
  • No changes can be made to tender notice tender papers after they are published. However, if changes are required, the procuring authority has to obtain prior approval from the competent authority. 
  • Every bidder has to submit Earnest Money Deposit via RTGS/NEFT/DD/FDR from the bank account of the concerned bidder. EMD may be 1% of the total bid cost for a project value up to ₹1.5 Crore and 0.5%/₹1.5 lakhs, whichever is more, for a project value above 1.5 Crore. 
  • Security Deposit may be 2% for projects up to 1.5 Crore value and 1% for projects up to 1% of the bid cost (rounded to the next ₹1,000/-).

  • Bidders have to solely bear all the costs associated with preparing and submitting online bids. The procuring authority is not responsible for these costs, regardless of the conduct or outcome of the bidding process. 
  • Bidders must know that any corrigendum issued related to the bid notice will be published on https://mahatenders.gov.in.
  • The bid must be submitted online via https://mahatenders.gov.in. In two envelopes: Technical Bid, Commercial Bid, and EMD and Bid Fee. Ensure all required documents are properly signed, sealed, and uploaded. 
  • The prices quoted and accepted during bidding will be on the bidder and valid for one year from the date of signing the contract. Any increase in price during this one year may not be entertained. 
  • The selected bidder must furnish a Performance Security Deposit of 3% of the contract/order value to the concerned authority within 15 days from the date of communication of the Selected Bidder. It must be mentioned in the Contract by paying the requisite stamp duty in favor of the Government of Maharashtra. 
  • The Performance Security Deposit is released by the Authority and returned to the Contractor upon receipt of demand from the supplier within 60 days following the date of completion of the Supplier's performance obligations, which includes the warranty obligation under the contract.
