Related to Preliminary Examination: 

  • Bidders must not contact the Procuring Entity regarding any matter related to the bid during the bidding process, particularly from bid opening to the time of contract award. Bidders may contact us on request and with prior written permission. 
  • If a bidder tries to influence the Procuring Entity for bid evaluation, bid comparison, or contract award decisions, it will negatively affect the process and can result in the rejection of the bidder's bid. 
  • Delhi Tenders may remain unresponsive in case of several conditions: 

(i) If submitted tenders are not in the required format, unsigned, or not signed following the stipulations in the tender document. 

(ii) If EMD is not provided or an exemption is claimed without acceptable proof of exemption. 

(iii) If the bidder does not fall under any eligibility criteria. 

  • Tenderers must have the right to question the procuring entities for rejection of bids at the Techno-Commercial Stage.

Reservation of Procurement of a certain class of Products:

  • The Pharmaceutical Purchase Policy, 2013, is intended to ensure (i) drug security of the nation, (ii) availability of quality medicines at low prices to the masses, (iii) optimum utilization of the installed capacity, and to provide a necessary fillip in reviving these ailing pharmaceutical CPSEs. 

Forms of Securities, Payment Terms, and Price Variations: 

  • Bid Security (also known as Earnest Money Deposit) is obtained from respective bidders along with their bids to create a safeguard against bidders withdrawing or altering its/his bid during the bid validity period in case of advertised (OTE and GTE tenders) or limited tender enquiry. 
  • Bidder's bid security shall be fortified in case the bidder withdraws or amends/its tender or impairs/derogates from the tender in any respect within the period of validity of the tender or in case the successful bidder fails to furnish the required performance security within the specified period. 
  • Performance Security/Performance Bank Guarantee (PBG)/Security Deposit (SD) is often obtained from the successful bidder awarded the contract. The Performance Security would vary between 5-10% of the total value of the contract as specified in the bid documents. 
  • The Performance Security would be fortified and credited to the procuring entity's account in case of breach of contract by the contractor. However, if the contractor duly performs and completes the contract, the amount would be refunded to the contractor without interest in all respects, but not more than 60 days after completion of all such obligations. 
  • When it comes to works and capital equipment, the procuring agency often issues a defect liability/warranty clause against defects arising from design, material, workmanship, or any omission on the part of the vendor or contractor during a specified period of months from the date of commissioning or the date of dispatch in case of goods. 
  • Bank guarantees submitted by Delhi tenderers/suppliers in the form of EMD/performance securities must be immediately verified by the issuing bank before acceptance. 
  • In case of Terms of Payment for Domestic Goods, where the terms of delivery are for Dispatching Station, the payment terms, based upon the value and nature of goods, mode of transportation, etc., would be 60% to 90% on proof of dispatch and other related documents and balance on receipt at site and acceptance by the consignee.

About PPD: 

  • The Indian Government has created a Procurement Policy Division (PPD) in the Department of Expenditure, Ministry of Finance, to promote uniformity and harmonization in the public procurement processes. 

Applicability of the Manual: 

  • Guidelines mentioned under this manual will not be applicable to projects funded by the World Bank and other International Funding Agencies. 

Related to MSMEs: 

  • The Indian Government has also created the Procurement Policy for Micro and Small Enterprises, 2012 [amended 2018 and 2021] in exercise of the powers conferred in Section 11 of the Micro, Small, and Medium Enterprises Development (MSMED) Act 2006. 
  • All the MSMEs (Micro and Small Enterprises) registered under Udyam Registration can have benefits under the policy. 
  • Delhi's procuring authorities provide MSMEs with tender documents free of cost, exempting them from payment of earnest money deposit to reduce the transaction cost of doing business. However, a Performance Bank Guarantee is not exempted under this policy. 
  • The procuring entities are required to stipulate their tender-specific criteria for the award of a contract to avoid any ambiguity during the bid evaluation process. 

About the Eligibility of 'Class-I Local Supplier'/‘Class-II Local Supplier’/ ‘Non-local suppliers’ for different types of procurement: 

  • While the Nodal Ministry/Department has communicated that there is sufficient local capacity and local competition, only Class-I local suppliers would be eligible to bid, irrespective of purchase value. 
  • Only 'Class-I local supplier' and 'Class-II local supplier' would be eligible to bid on procurements undertaken by procuring entities, but not in the case when a Global tender enquiry has been issued.
