Tenders are invited for Hiring a Consulting Firm to Review the Condominium Law and Elaboration of its Implementing

The general objective of this consultancy is to review the condominium law and elaborate its implementing tools. Under this objective, the following will be the scope of work:

Carry out a critical review of the existing Law N° 15/2010 of 07/05/2010 creating and organizing condominiums and setting up procedures for their registration
Conduct a survey on sampled existing real estate buildings (commercial and residential) both registered and none registered in condominium across districts and the city of Kigali. The survey should include the views of various group of stakeholders including but not limited to district and city officials; developers; real estate management firms; home/unit/building owners; residents/tenants, etc
Use collected data and surveys to conduct SWOT analysis for condominium housing in Rwanda and how it can be promoted.
Base on the critical review of the existing law and SWOT analysis of the conducted survey to propose solutions to the identified gaps including but not limited to the following:
establishment of a condominium limited to co-owners and public institutions in charge of housing;
rights on lands in a condominium ;
management of a condominium limited to associations;
surveying/valuation modalities in a condominium;
Management and sharing of costs in a condominium including operation and maintenance of the building(s) both public and private spaces and other infrastructure or services
roles and responsibilities of parties involved in condominium;
common/private elements in a condominium ;
taxing modalities in a condominium ;
titles in a condominium;
regulation of possible disputes arising from a condominium ;
possible transactions in a condominium ;
strategic environmental protection in a condominium ;
Based on the identified gaps, identify and research relevant case studies/best practices regionally and/or internationally with success stories of condominium housing to find solutions to address such gaps that will be reflected in the revision of the law.
Propose and organize virtual knowledge exchange to better understand best practices in condominium that can be easily contextualized in Rwanda.
Based on proposed solutions to the identified gaps, recommend and elaborate possible implementing tools for the anticipated revised law. The implementing tools will consider areas related to the establishment and management of condominium, practical strategies for the development and management of the real estate in condominium among others.
