In this regard the candidate must produce, together with the application form, a copy of the approved company financial statements for the last 3 financial years. The newly formed companies, with the exception of those arising dthe merger / incorporation of existing companies must be able to provide a copy of at least one financial statement for the year prior to the date of this call for proposals.

In the case of groupings of companies, all members must present their financial statements. In the case of consortia, the financial statements must be provided by both the consortium and the individual consortium companies-On the basis of the aforementioned financial statements, the candidate, on pain of exclusion from the tender, must provide evidence of the achievement of an average annual production value of not less than EUR 10 000 000. In the event that the candidate is the head of a group of companies, the aforesaid value can be deduced from the related consolidated financial statements. For the above purposes we mean:

- Group of companies: an insof companies that are independent from a legal point of view but are subject to a single economic entity

- Consolidated Financial Statements: final financial statement describing the economic, patrimonial and financial situation of a group of companies, drawn up by the top company ( group leader) and drawn up according to the provisions of the law and in compliance with the accounting regulations in forceenti

- Company balance sheet: final financial statement describing the economic, asset and financial situation of a company, considered individually, drawn up according to the provisions of the law and in compliance with the accounting regulations in force.

In the case of groupings of companies and consortia, pursuant to art. 48 of Legislative Decree 18.4.2016 n. 50, the aforementioned value of production decan be held to the extent indicated in art. 47 and 48 of Legislative Decree 18.4.2016 n. 50.

a) Duplication of requests to participate and tenders is not allowed either direct or through.

B) The application form does not bind the contracting entity in any way. The contracting entity reserves the right to forward the invitations to the candidates selected by it, setting the termsfor the submission of offers. This announcement and the receipt of any offers do not entail any obligation or commitment to the contracting entity to award bidders to any bidders granting them any right to any performance by the contracting entity for any reason whatsoever. The adjudicating entity also reserves, at its sole discretionthe judgments and without any right or claim by the possible candidates, to cancel the present announcement.

c) In case of bankruptcy of the candidate or of forced liquidation or of a preventive arrangement of the same during the execution of the eventual contract, except in the case referred to in Article 186-bis of the Royal Decree of 16.3.1942 n. 267 (pre-arranged with continuous businessendale), or termination of the contract for serious breach of contract or withdrawal from the contract pursuant to art. 92 of Legislative Decree 6.9.2011 n. 159, the adjudicating entity will have the faculty to continually question the other candidates who participated in the present tender procedure, resulting from the relative ranking, in order to stipulate a new contract for the assignment of thecompletion of the activities covered by this announcement. It will proceed to the interpolation starting from the subject that has formulated the first best offer, up to the fifth highest bidder, excluding the original contractor. D) The use of subcontracting is permitted. The invitations to tender will be accompanied by the specifications of the clauses and general conditions that will indicate, between thethe category (s) and / or any percentage for which the subcontract is admitted, including the conditions for the relevant authorization; the technical specifications, the specific conditions, on the basis of which the offer must be formulated.

e) The envelope containing the application form must include the wording and must contain the application form and the relative documentoriginal and a copy in digital format (eg CD, DVD, external storage devices). In the event of inconsistencies or incompleteness of the digital format compared to the documentation provided in the original, the latter prevails.

F) Documents sent by fax or e-mail will not be accepted.

G) The application form does not have to report prices or rates.

h) At the time of-submission of applications for participation, the candidate is required to indicate the domicile for office communications relating to this announcement and the fax number to receive the aforementioned communications. The candidate must also indicate his e-mail address (specifying if it is a certified e-mail) and expressly authorize the agency tojudge to use the fax as a means of sending the aforementioned communications.
