Selection procedure for the granting of remote gaming of public games
Selection procedure for the awarding of 120 concessions for the remote exercise of public games pursuant to the law of 28.12.2015, n . 208, art. 1, paragraph 935, through the activation of the remote network and its management. The public games object of the concessionthe following are: betting, fixed odds and totalizator, on events, even simulated, sports, including those relating to horse racing, as well as other events; competitions for sports and horse races; national horse racing games; skill games, including card games in tournament mode and in a different mode, as well as fixed odds; fixed odds bets with indirect interaction between the players; bingo.
Awarding of 120 concessions for the distance exercise of public gaming pursuant to Law 28.12.2015, n. 208, art 1, co. 935 through the activation of the remote network and its management. The assignment in concession and subject to payment, at the time of communication of the verification of the requirements, of a consideration alump sum of EUR 200 000.00 (two hundred thousand / 00). The concession has a duration until 31.12.2022. The candidate is required to attach to the request for participation appropriate documentation proving the provision of the provisional guarantee constituted in the numerario or in public debt securities guaranteed by the State on the day of filing, at a provincial treasury section or presI know the companies authorized as a pledge in favor of ADM, or through a bank guarantee or insurance, issued by one or more banks, credit institutions or insurance companies, which meet the solvency requirements established by the laws governing their respective activities, in the form of an independent guarantee with respect to the principal obligation, upon first request, ogni exception removed and with express renunciation of the benefit of the preventive enforcement of the principal debtor and the exception referred to in Article 1957, paragraph 2 of the civil code as well as with the provision of the same guarantee within 15 days at the simple written request of the contracting authority . The amount of the provisional guarantee must be EUR 100 000.00 (one hundred thousand / 00)ie equal to the half of the contribution due for the awarding of the concession in accordance with Article 1, co. 935, of the L. n. 208 of 2015. The provisional guarantee must be effective and valid for a period of one year from the submission of the application and must be renewed, if the stipulation of the agreement does not take place within the said term, up to the date of stipulation. ADM, availingyes of a special Selection Commission, nominated by a subsequent provision, verifies the existence of the documentation as well as the possession of the requisite requisites and the fulfillment of the prescribed conditions and burdens. All the questions produced will be examined in compliance with the chronological order of presentation up to the number 120. In the event of incompletesends, or relative documentation, the provisions of Article 83, paragraph 9 of Legislative Decree no. 50 of 2016 without prejudice to the chronological order assigned to the application. The applications will be presented in closed packs, the methods of opening will be announced on the site, expired the terms The assignment in concession can take place only in respect of joint-stock companies. In the prexemption of the application for participation individual companies, partnerships, consortium companies, consortia and consortium companies must expressly be obliged to form or become a joint-stock company having its registered office in one of the States of the European Economic Area before of the signing of the agreement. The constitution or transformation nThe capital company itself is an essential condition for signing the agreement. Those already established in the form of a limited company must establish their registered office in one of the States of the European Economic Area before the concession is granted and the relevant agreement is signed. In case of non-compliance, in addition to proceeding with the exclusionone from the awarding of the concession, ADM will also proceed to enforce the provisional deposit presented for participation in the concession award procedure. By signing the application form, the candidate assumes the obligations listed in article 24, paragraph 17, of Law 7.7.2009, n. 88.
Participation in the concession and open custody procedure-to gaming operators operating in Italy or in another State of the European Economic Area, on the basis of a concession, authorization or other authorization issued by the competent authority of the State in which the gaming operator has its registered office or operational headquarters, at least one type of game among those belonging to the games portfolio managed by ADM. They can partecalso subjects who operate in sectors other than gaming or in game activities offered outside the European Economic Area or in gaming activities offered in the European Economic Area with total revenues for the two-year period preceding the date of submission of the lower demand to EUR 1 500 000.00 (one million five hundred thousand / 00), provided they are in possession, even for-through controlling or controlled companies or associates, of a technical-infrastructural capacity, proven by a specific technical report signed by an independent entity, having the characteristics indicated in the technical rules of the selection procedure and providing bank guarantee and monopolies to the Customs Agency or insurance, on first demand and for two years, amounting to EUR 1 500 000.00 (one million five hundred thousand / 00). The verification of the requirements is carried out by ADM. Individual companies, partnerships, joint-stock companies, consortium companies, consortium companies and company companies may participate in the concession procedure, paying, once the verification of the requirements has been completed, the consideration indicated by theArticle 1, paragraph 935 of Law no. 208 of 2015. Under penalty of exclusion from the concession procedure, the participant must attach to the application - according to the procedures described in the Administrative Rules - a copy of the receipt of the contribution to the National Anti-Corruption Authority together with a copy of a document identity in course of validity, which incase of company and that of the legal representative. For the purposes of this procedure, the tender identification code (CIG) is as follows: 73435644B8. The payment due by each participant is equal to EUR 500.00 (five hundred / 00) and must be made according to the procedures available on the website www.anticorruzione.it within the submission deadline. The verification of the poof the general, technical-professional and economic-financial requisites, pursuant to art. 81, paragraph 2, of Legislative Decree no. 50/2016 and ss.mm.ii., through the use of the AVCpass system, made available by the ANAC with the implementing resolution no. 111 of 20.12.2012 and ss.mm.ii. All subjects interested in participating in the procedure must, compulsorily, register with the sistheme AVCpass according to the operating instructions for registration on the site: www.anticorruzione.it. The economic operator, having made the aforementioned registration to the AVCpass service and having identified the award procedure to which he intends to participate, obtains a "PASSOE" from the system; the same must be included in the administrative documentation.
A substitutive guarantee of the rfirst requirement of two-year economic, financial, banking or insurance capacity, equivalent to 1 500 000.00 EUR (one million five hundred thousand / 00) by the subjects in possession, also through parent companies or subsidiaries or affiliated companies, of a technical-infrastructural capacity, in sectors different from the game or in game activities offered outside of theEuropean economic area or gaming activity offered in the European Economic Area with total revenue for the two-year period preceding the date of submission of the application of less than EUR 1 500 000.00 (one million five hundred thousand / 00). This guarantee must be effective and valid for a period of two years from the submission of the application for participation and has as its object theeconomic soundness and continuity of the exercise of the activity demonstrated by the ability to fulfill the obligations of the agreement with additional value for the part exceeding the guarantees already provided for in the agreement.
