Tenders are invited for Consultant in Support of the Burundian Administration in the Revision of Certain Legislative and Regulatory Laws Relating to the Civil Service.

In April 2012, Burundi set up a National Program of Public Administration Reform "PNRA" which aims at the establishment of a qualified, efficient, responsible administration oriented towards the general interest and the citizen service.

The reform strategy adopted is articulated as follows: (i) Improvement of the services provided to citizens through the establishment of one-stop-shops of public services in the various provinces and the simplification of procedures; (ii) Development of a new performance management in the Administration by supporting the implementation of the performance management policy, the classification of jobs and the revision of the remuneration system and the revision of certain texts on the Public Service and; (iii) Strengthening national capacities for designing public policies and coordinating government action.

These reform actions will involve a revision of the Public Service management rules and consequently of its institutional, legislative and regulatory framework. Indeed, the new performance management policy entails changes in the rating system which is at the base of the advancements of the civil servants. The job classification in the Public Service redefines the public service wage setting parameters that will be based more on the assumed value of each job and less on the applicant's qualifications as is the case in the current system. Also, the government has shown the will to consolidate a common core of basic rules applicable to all categories of public officials of the state to the detriment of the superposition of different specific body of law developed, mostly on the basis of categorical requests.

It is in this perspective that the mobilization of an international consultant in charge of supporting the revision of the institutional, legislative and regulatory framework of the Civil Service is planned. These are the general and particular statutes and the resulting texts.

Also, all the reforms carried out have effects on the organizational values ??of the Public Administration. Also, a draft Charter of the Administration and the Public Service is elaborated. This document will be at the base of the mutation of the values ??of the Public Service as an organization and as a social body playing a central role in Burundian society.

UNDP supports the implementation of the PNRA through the Support Project for the Implementation of the National Program of Reform of Public Administration (PNRA Project). The main objectives of the Project are: (i) improvement of the leadership and design capacity of the Government of Burundi; (ii) promoting the values ??of equity, transparency and performance; (iii) the development of a culture of public administration in the service of the citizen and the promotion of the use of ICT in the administration.

The Project is implemented according to the National Execution Modality (NIM). The main implementing partner is the Ministry of Public Service, Labor and Employment. Also, the Ministry has appointed a National Project Director. A letter of agreement has been signed between the MFPTE and UNDP for the provision by the latter of support services for which the organization has comparative advantages, particularly in relation to the purchase of goods and services. international services

It is in this context that UNDP is seeking the recruitment of an international consultant to support the revision of the institutional, legislative and regulatory framework of the Burundian Civil Service in line with the ongoing reforms.




Duties and Responsibilities

Main objective of the mission

Primary objective

The main objective of the mission is to support the Ministry of Public Service, Labor and Employment in the revision of the institutional, legislative and regulatory framework of the Civil Service in relation to the various reforms in progress, including the policy performance management, job classification, the new salary policy and the draft Administration and Public Service Charter.

Requested services

The mission is to carry out the following specific activities:

To make a documentary study on the General Statute of the Civil Servants, the particular statutes underlying them, the special statutes, the texts of application of these different statutes, the new documents and texts resulting from the new reforms including the policy and tools of management of the performance, job classification and the new salary policy, as well as and the underlying drafts, the draft Charter of the Administration and the public Service, managers papers public finance reforms the Organic Act Act s Finance in force, the Labor Code and any implementing regulations relating thereto and all other related studies and texts.

Meet the different stakeholders:

· the services of the Ministry of Public Service, Labor and Employment: General Directorate of Public Service, General Inspectorate of Public Service, General Directorate of Labor, General Inspectorate of Labor and Social Security, Permanent Executive Secretariat of the Reform of Public Administration, the National School of Administration

· the different officials in the functional areas defined in the classification of jobs; These areas are: (i) Administration, Diplomacy, Territory Administration; (ii) Justice and Legal Affairs; (iii) Finance, Purchasing, Management Control; (iv) ICT, Culture, Heritage; (v) Education, Training & Research; (vi) Health and Social Cohesion; (vii) food security; (viii) Energy, Mine, real estate, buildings, infrastructure; (ix) Logistics, maintenance, Human Resources and (x) steering of public policies - 7 to 12 people per functional area in a 2-hour workshop.

· the directorates and managers of the human resources management of the various ministries;

· the services of the Ministry in charge of Finance and Budget;

· unions representing state agents;

· training organizations including the National School of Administration, the Training Center for the Trades of Justice, the Training Center for Municipal Executives, the University of Burundi;

Organize the reflection with a base of managers of the Administration in order to identify the blocking factors that hinder the management of men and the elements of innovation that could bring improvements;

Identify the challenges and levers to promote the implementation of performance management and merit of the Public Administration;

Organize a workshop to present the elements of evaluation and identification of the areas for improvement;

Make proposals for texts for revision or creation with explanatory memoranda;

Work with stakeholders for ownership.

The field of intervention includes all the institutions whose operating budget emanates from the General Budget of the State. These include: central and provincial administrations (governorates and provincial directorates) as well as state superstructures (Presidency of the Republic, First and Second Vice-Presidencies of the Republic, National Assembly, Senate, General Secretariat of the Government Office of the Ombudsman and other administrations such as the University of Burundi).

Expected results of the mission

Main result

The main expected result is as follows: the institutional, legislative and regulatory framework for the management of the civil service is in line with the new reforms undertaken and facilitates their implementation.

The main deliverables are:

· A methodological note on the understanding of the terms of reference, the proposed methodology;

· A status report including: (i) an analysis of the current institutional, legislative and regulatory framework of the Public Service, its strengths and weaknesses; (ii) a presentation of the ongoing reforms and involvement s on the institutional, legislative and regulatory Public Service; (iii) the conditions for success to increase the effects of reforms towards the final effect of the reform (a public administration that is qualified, efficient, transparent, accountable, oriented towards the general interest and service to the citizen); (iii) proposals for revision or creation of the institutional, legislative and regulatory framework of the civil service (general and private statutes, other texts);

· The different proposals for texts in revision or creation with the explanatory memorandum.

· The mission report including the reports of the various stakeholder engagement and product approval workshops.

The revision of the Public Service's institutional, legislative and regulatory framework stems from the job classification and the development of the wage policy, which required the setting up of a Technical Monitoring Committee. The said Committee is composed of the different ministries as well as the technical services directly concerned with the management of the State's human resources. It is under the chairmanship of the Permanent Executive Secretary of the Reform of the Public Administration. This Committee constitutes the framework for validating the results of the mission.

Other mission stakeholders are:

· The General Directorate of the Public Service, in charge of the management of State personnel;

· The National Recruitment Commission in charge of drawing up the recruitment plan on the basis of the needs expressed by the various ministries and transmitted to the Ministry in charge of the Public Service in its attributions;
