CENTRALSUPPLY AND TENDERS BOARD CSTBNO?3250?..ADVERTISEMENT Papua New Guinea Rural Communications Project REQUEST FOR EXPRESSIONS OF INTEREST (Consultancy Services) FOR A CONSULTING FIRM TO ASSIST WITH ECONOMICAND TECHNICAL REGULATION WITHIN NATIONALINFORMATION AND COMMUNICATIONS TECHNOLOGY AUTHORITY (NICTA) The Government of Papua New Guinea has received aCredit (Cr.47910) from the International Development Association (IDA) towards the costs of thePapua New Guinea RuralCommunications Project, and intends to apply part of the credit for the consultancyservices.
The consultancy serviceswill serve to engage aConsultancy Firm to assist NICTA in the continuing development and implementation of a sound regulatoryframework in Papua New Guinea and assist with the institutional capacity of NICTA in regulating the ICT sector.
The overall aim isto increase competition, promote access to infrastructure and services, improve quality of services and consumer satisfaction anddevelop institutional capacity in the process.Scope of Work Task 1: Recommendations for promoting open access to core broadband infrastructure on equitableterms.In this task the consultant will recommend how best to ensure open access to core broadbandinfrastructure on equitable terms. This work will include analysis and recommendations on:A. Definition, scope and application of "open access" obligationsA. How best to ensure open access to essential facilities, especially broadbandinfrastructureA. Measures for regulating open access at differentnetwork layers, where consideration of suchmeasures to ensure transparency and non-discriminatory accessA. Review of standard and special conditions license Rule. Task 2: Review of wholesale markets The consultant will review wholesale markets and support NICTA in undertakingpublic inquiries into the following wholesale services and such other inquires as determined by NICTAunder section127(1). o Domestic inter-exchange transmissionserviceso Domestic transmission tailserviceso Domestic digital data and or voice resaleserviceso Unbundling of specifiedfacilities located between a local exchange and the networkboundaryo Facilities access servicesassociated with fixed networkfacilitieso Facilities access servicesassociated with mobile network facilities o Domestic inter-network mobile roamingservicesIt is expected that the work will include the scoping of relevant market for each service andassessing the currentand future market conditions. The deliverable includes theinquiry report(s) and declaration report(s) to the Minister. Task 3: Review of inbound international call rates, Internet rates and international roamingratesUndertake a review of inbound call rates, Internet and international roaming rates and, ifappropriate, assist NICTA with the inquiry process and reporting obligations, including declaration report(s) to the Minister.
Theconsultant will also undertake a Feasibility Study on the establishment of IXPs in PNG. Task 4: Review of existing subordinate instrumentsAmendments to the National ICT Act are expected to be submitted to Parliament for considerationby the end first quarter 2015. The consultant will assist in undertaking a review ofall existing subordinate instruments (including Regulations, Rules, Determinations and Guidelines) and will recommend amendmentsandupdates. Task 5: Market Investigation and AssessmentsAssist NICTA from time to time in carrying out investigations and making assessments in respectof potential instances of anti-competitive conduct (whether in response to complaints from operators, or at NICTA''''s owndiscretion).Assist in the preparation of apublic guidance note describing NICTA''''s approach to marketanalysis, particularly market definition matters in wholesale market assessment, investigations and regulation. The scope for this task will be further discussed and agreed during inception. Task 6: Mergers andAcquisitionsAssist NICTA from time to time in relation to any mergers or acquisitions over which NICTA hasjurisdiction, including in relation to advice which NICTA provides the ICCC pursuant to the terms of an MOU between thetwoagencies.

Task 7: Undertake reviews of various interconnection agreements and develop a cost model forinterconnection and accessThe consultant will assist NICTA in reviewing mobile termination and fixedterminationinterconnection agreements between licensed operators andassess for compliance with the general pricing principles andservicespecific principles and will provide recommendations for dealing withany potential inconsistencies. The consultant will also assist NICTA in establishing a cost model to guide the assessmentof interconnection rates.
The task will also include the review of existing tariff determinations and advise on retail and wholesale rates monitoring mechanisms and advising on dispute resolution betweenoperators. Task 8: Assist in the preparation and award of wireless/mobile licence(s)The consultant will:A. Assess the market situation, analyse general trends, sector trends and future evolution for thepurposes of promoting the award of new licencesA.Recommend the appropriate means of licensingA. Prepare all documentation to be made available to bidders including technical specificationsA. Assist with evaluation of bids, selection and preparation of reports including evaluation andrecommendation reportsA. Assist with the preparation of terms andconditions of licence The scope for this task which will be further discussed and agreed duringinception. Task 9: Quality of Service (QoS) and consumer protection regimeThe consultant will:A. Review of current guidelines.A. Develop of QoS standards with appropriate consumer specific parameters.A. Develop evaluation parameters or key QoS indicators and benchmark criteria of the network andservice quality levels offered by mobile operators and ISPs.A.Develop performance standards and objective assessment methodologies of QoS for publictelephone, mobile telephone service, Internet Access and broadband Internet services.A. Develop key QoS indicators, setting out clearly what the QoS network performance indicators areand set targets for PNG.A. Develop a mandatory QoS reporting requirement for serviceproviders.A. Assist with the development of a method of collecting and interpreting QoS issues from thepublic.A. Assist in identifying or developing a database or repository to store and process QoS data. Task 10: Develop a tariff scheme fornumbering resources.The consultant will review current number charging practices and update and or develop acharging scheme for national numbering resources.
The consultant will help develop a consultation document setting out therationale for imposing such charges and a schedule of rates for numbering resources. Task 12: Public Inquiry into the Potential Implementation of NumberPortabilityThe consultant will assist NICTA in undertaking a public inquiry into the potentialimplementation of Number Portability, including the inquiry report and declarationreport to the Minister. The task will entail the following:A. Develop and publish a Discussion Paper identifying the costs and benefits of implementingmobile number portability inPNGA. Consultation with industry and stakeholders A. Assist NICTA in public hearings and call for submissions A. Following receipt of submissions or hearings prepare a final report for submissionto theMinister by NICTA identifying:o NICTAs recommendation whether thenational numbering plan should be amended to implement mobile number portability in any formo The basis for NICTA''''srecommendationo The proposed form of rules oramendments to the national numbering plan o The costs and benefits ofimplementing that form of number portabilityA. Develop an implementation plan for number portability whereappropriate.Undertake and implement the decisions of the Public Inquiry. Task 13: Training and CapacityBuildingConduct in-house training for selected NICTA staff on regulatory issues, from time to time, inparticular on matters relating to wholesale regulation, rates, quality of service, consumer protection issues and numberingresources management and number portability. Selected NICTA staff will be attached tothe project and the consultant will mentor and guide them during the entire period of assignment to build institutionalcapacity. The scope for this task will be furtherdiscussed and agreed duringinception.
The task will include conducting of courses (about 5 weeks) in the areas of Regulatory Economics, Consumer Protection, Access and Interconnection, SpectrumEconomics and management, Numbering and Number Portability, Task 14: Expert AdviceThe consultant will provide expert advice, from time to time, on various regulatory issues asinstructed by NICTA and support NICTA on regulatory economic analysis, market assessments and investigations. As part ofthis taskthe consultant shall prepare reports as may be required periodically by NICTA on status, progress etc. on the above tasks. The scope for this task will befurther discussed and agreed during inception.
