The way of fulfilling the requirement: the bidders / members of the association / the subcontractors / third-party supporters will complete the DUAE with the information related to their situation. at the time of presentation [such as:

- certificates attesting the lack of outstanding debts cu regarding the payment of taxes, taxes or contributions to the general consolidated budget (local budget, state budget, etc.), respectively equivalent documents for foreign economic operators,

- the criminal record of the economic operator and of the members of the administration, management or of supervision of the respective economic operator or of those with the power of representation, decor control within it, as it results from the certifying certificate issued by the ONRC / the constitutive document,

- documents proving that the economic operator can benefit from the derogations provided in art. 166 para. (2), art. 167 para. (2), art. 171 of Law no. 98/2016, as well as any other edifying documents, as the case may be], will be presented, at the request of the carof the contracting authority, by the bidder ranked in the first place in the ranking drawn up at the end of the evaluation of the bids or by any bidder, at any time during the evaluation process, if the contracting authority considers this necessary.

Requirement no. 2: the bidders / members of the association / subcontractors / third-party supporters must not be found in the situations provided in art.. 58-63 of Law no. 98 / 2016.

The way of fulfilling the requirement: the bidders / members of the association / subcontractors / third-party supporters will complete and submit, together with the DUAE and with the offer, the declaration on their own responsibility regarding the non-conflict of interests, according to the model made available by the authority contracting in the "Forms" sectionthe role of the contracting authority are:

If applicable, the following documents will be submitted with the DUAE: the association agreement and / or the firm commitment of the supporting third party, from which to show the effective way in which it will materializealize its support and / or the subcontracting agreement

Provisions applicable to all requirements: several economic operators have the right to associate with the purpose of submitting a common offer, without being obliged to adopt or constitute a certain legal form for the submission of the offer .

The economic operator has the right, if applicable and in connection with a certain public procurement contract /framework agreement, to invoke the support of a third party regarding the fulfillment of the criteria regarding the economic and financial situation and / or of the criteria regarding the technical and professional capacity, irrespective of the nature of the legal relations existing between the economic operator and the respective third party / third party / question.
