General Requirements:

- Equipped with Winston Lutz Testing System Needed Inaintreatment,

fine beam and system for quality assurance of the equipment; it must be very well calibrated and checked; the difference of 1 mm in the isocentric position means that the target can be missed and thus a critical structure can be irradiated with significant and severe consequences, - Camera equipment camera is mandatory for monitoring breathing patients- the equipment will be a linear high energy accelerator capable of providing the following treatment techniques: conformal RT, IGRT, IMRT, VMAT techniques, stereotactic SRS / SBRT and CBCT stereotactic radiotherapy, - to perform mandatory techniques, the system must to include in the delivery configuration packet for dosimetry, pack for immobilization elements and position systemslaser alignment, perfectly compatible with the existing systems within the Radiotherapy Laboratory, - the accelerator will integrate into the existing oncology computer system for patient management and will also be compatible with the existing treatment planning system.

Exclusion, in accordance with Chapter IV, Section 6, paragraph 2.

Bidders, third parties, holders and subcontractors should not be found in the situations referred to in art. 164, 165, 167 of Law no. 98 / 2016.

The manner by which the fulfillment of the requirement can be demonstrated: the economic operators participating in the award procedure (including any third parties and subcontractors) will be filled in with the information related to their situation.will prove the fulfillment of the assumed by completing the DUAE only at the request of the contracting authority, only by the tenderer placed on the first place following the application of the award criterion. These documents may be: - certificates of tax certificates regarding the lack of overdue debts, on the payment of taxes, duties or contributions to the consolidated general budget (buget local, state budget, etc.) at the time of submission, - the criminal record of the economic operator and the members of the administrative, management or supervisory body of the economic operator or of those having the power of representation, decision-making or control within it, as it results from the certifying certificate issued by the ONRC / constitutive document, - as the case may be, documents pwhich demonstrates that the economic operator may benefit from the derogations provided for in Art. 166 par. (2), art. 167 par. (2), art. 171 of Law no. 98/2016 regarding public procurement, - other editing documents, as the case may be.

The bidders / associate tenderers / third-party supporters / subcontractors must not find themselves in the situations stipulated in art. 59, 60 of Law no. 98/2016

Fashionthe ability to demonstrate the fulfillment of the requirement: the DUAE will be completed by the economic operators: bidders / associates / subcontractors / third party participants in the award procedure with the information related to their situation. Declaration on own responsibility for non-compliance with the provisions of art. 60 of Law no. 98/2016 will be presented with DUAE by all participants(tenderer, associate, subcontractor and third party).

The economic operators submitting a tender must prove a form of registration according to the law of the country of residence, that the economic operator is legally constituted, is not in any of the situations of cancellation of establishment, and that he has the profitable capacityThe way to prove the fulfillment of the requirement: it will be completed by the economic operators participating in the award procedure with the information related to their situation.

The supporting documents proving the fulfillment of the assumed by completing the DUAE, respectively:

- Certificate issued by the ONRCor in the case of foreign tenderers, equivalent documents issued in the country of residence, - the operating permit issued by NAMMD, according to WHO no. 1008/2016, valid for activities: import of medical devices, storage and distribution of medical devices, repair, maintenance, commissioning / installation of medical devices, are to be presented at the request of the contracting authorityante, only by the bidder placed on the first place after applying the award criterion, drawn up at the completion of the bid evaluation, containing real / actual information at the time of the presentation. Specify the average annual turnover. Global turnover average over the last 3three years (2016, 2017, 2018) will be at least equal to RON 30, 000, 000.00.

Requests for clarification regarding this tender documentation will exclusively address SEAP in the "Questions" section of the award procedure conducted by electronic means, and the responses to them will be published in the SEAP to the "Documentation and clarification" section of the announcement / invitation to participate, the contracting authority will not respond to the requests addressed by a different means of communication than the established one.

DUAE can be accessed in order to be filled in at SEAP address. where it is found that the admissible tenders ranked first have equal prices, the contracting authoritywill request re-routing through SEAP for the electronic loading by the economic operators of documents containing new prices. The Bidder assumes sole responsibility for the legality and authenticity of all the documents presented in the original and / or copy for participation in the procedure. Analyzing the documents submitted by the bidders by the Commissionevaluation does not impose any liability or liability on its part to accept it as genuine or legal and does not remove the exclusive liability of the offeror in this respect.
