Contract for the supply of equipment necessary for the implementation of the research project according to the Subsidiary Contract no. 22671 of 8.8.2018, having as object "Ithe identification of prognostic biomarkers and the prediction of the response to therapy in breast tumor pathology "and the subsidiary contract No. 22672 of August 8, 2018, entitled" Identification of prognostic biomarkers and prediction of the response to therapy in uterine cervical pathology " cervical brachytherapy and breast brachytherapy.

We wish to purchase brachytherapy facilities according to the specifications in the specification ..

- Cervical brachytherapy plant,

- Breast-brachytherapy facility

Bidders and subcontractors (if known at the moment of submitting the offer ) of the bidder, should not be in the foreseeable situationto art. 59, art. 164, art. 165 and art. 167 of the Law no. 98/2016. The way by which the fulfillment of the requirement can be demonstrated: it will be completed by the economic operators participating in the award procedure with information related to their situation. DUAE will be submitted, as the case may be, also by the subcontractor. Will be deposited with DUAE: subcontracting agreement (Form 3) if youthe contractors are known at the time of submission of the offer, and / or the association agreement (Form No. 5), as the case may be. The declaration of non-compliance with the provisions of art. 59 of Law 98/2016 shall be submitted with the DUAE by the tenderers and subcontractors (if they are known at the moment of submitting the tender), according to Form no. 9. The supporting documents proving the fulfillment of theassumed by the completion of the DUAE, shall be loaded in SEAP at the request of the contracting authority, only by the bidder ranked first following the application of the award criterion. These supporting documents may be: - - certificates showing the lack of overdue debts regarding the payment of taxes, duties or contributions to the general consolidated budget (local budget, budgetstate, etc.) at the time of presentation, - the criminal record of the economic operator and of the members of the administrative, management or supervisory body of the economic operator or of the persons having the power of representation, decision or control within the economic operator, as it results from the certifying certificate issued by the ONRC / constitutive act,

- as the case may be, documents by which the demostates that the economic operator may benefit from the derogations provided in art. 166 par. (2), art. 167 par. (2), art. 171 of Law no. 98/2016 on public procurement, - other documents, as the case may be.

Foreign bidders shall present any editorial documents issued by the competent authorities of the country of origin or of the country where the tenderer is established, proving inthe fulfillment of the above requirement in accordance with the legislation of the country of origin or of the country where the tenderer is established. Documents will be presented accompanied by their authorized translation into Romanian. The information from the presented documents will be real and current at the time of the presentation. Concerning the non-compliance with the provisions of art. 59 of the Law no. 98/2016, personsthe decision-making bodies of the contracting authority involved in the awarding procedure are:

The economic operators submitting the tender must prove a registration form under the lawof residency, that the economic operator is legally constituted, that he is not in any of the situations of cancellation of the establishment and that he has the professional capacity to carry out the activities that are the object of the contract. The way by which the fulfillment of the requirement can be demonstrated: the DUAE will be filled in by the economic operators participating in the award procedureinformation about their situation.
