The bidder / associate bidder / subcontractor / third party supporter must not be in any of the situations provided in art. 164, 165, 167 of Law no. 98 / 2016.

In view of the Notification 256/2016, all the bidders, with the DUAE submission to present the commitment of the third party (together with documentsThere are annexes to the commitment, transmitted to them by the third party / third party supporters, from which the effective way in which his / her support will materialize), the association agreement and the subcontracting agreement. The supporting documents proving those assumed in commitments / agreements will be requested only by the tenderer ranked in the first place in the intermediate ranking drawn up at the endarea of the evaluation of the offers.

The DUAE will be completed by the economic operators participating in the award procedure with the information related to their situation. The supporting documents proving the fulfillment of those assumed by completing the DUAE will be presented, at the request of the contracting authority, only by the bidders ranked first in the intermediate ranking drawn up at the endlises the evaluation of the offers at the request of the contracting authority.

These documents are:

1) certificate of fiscal attestation regarding the lack of the outstanding debts regarding the payment of taxes, taxes or contributions to the general consolidated budget (local budget, state budget, etc.) at the time of presentation issued by the Ministry of Public Finance or its subordinate units

Which have the qualityof budgetary creditor;

2) certificates certifying the lack of debts regarding the payment of taxes, taxes or contributions to the general consolidated budget (local budget, state budget, etc.) at the time of presentation;

3) the criminal record of the economic operator and the the members of the administrative, management or supervisory body of the respective economic operator, or of those who haveu power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / the constitutive act;

4) as the case may be, documents demonstrating that the economic operator can benefit from the derogations provided in art. 166 para. (2), art. 167 para. (2), art. 171 of Law 98/2016 on public procurement. Declaration according to art. 60 of the Law98/2016, which will be presented by all participants once the DUAE has been submitted.

Details:

- In case of submitting a common offer, the requirement must be fulfilled by all the members of the association, as well as by the third party (s), the subcontractor / subcontractors, if any, by completing the DUAE according to art. 193 para. (1) of Law 98/2016. Taking into account the Notification 256/2016 all the bidders oncewith the DUAE submission to present the commitment of the third party supporter (together with documents annexed to the commitment, sent to them by the third party / third party supporters, from which the effective way in which his / her support will materialize is shown), the association agreement and the subcontracting agreement. The supporting documents proving those assumed in commitments / agreements will be required onlyto the bidder declared the winner at the request of the contracting authority,

- In the case of the country of origin or the country where the bidder is established, documents of a judicial record are not issued, the contracting authority has the obligation to accept a statement on its own responsibility or, if in the respective country there are no legal provisions regarding the declaration on its own responsibility, an authentic statement given in front of a notary, an administrative or judicial authority or a professional association that has competence in this regard,

- Regarding the payment of the obligations to the state budget, the payment of local taxes and fees, at the DUAE level to attest the lack of outstanding debts at the time of presentation.

The way of separating the bidders ranked on the first place with equal price, will be separated by electronic re-offering of the price (following a request of clarifications from the contracting authority), to which the economic operators will send their answer online (in SEAP).
