Requirement no. 1.

The bidders, associations, third-party supporters and subcontractors must not be found in the previous situationsseen at art. 177, 178, 180 of Law no. 99 / 2016.

The method of fulfillment: the DUAE will be completed, by all the bidders, including by the associates, third-party supporters and subcontractors. only to the bidder ranked first after applicationof the award criterion on the admissible offers, including by the associates, third-party supporters and its subcontractors.

These documents will be:

- certifying certificates regarding the lack of debts regarding the payment of taxes, taxes or contributions to the general consolidated budget (local budget, state budget, etc.) at the time of presentation,

- the criminal record of the operator economic and of the members of the administrative, management or supervisory body of the respective economic operator or of those who have power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / the constitutive act; where applicable, documents proving that the economic operator can benefit from the derogations providedin art. 179 para. (2), art. 180 paragraph (2), art. 184 of Law 99/2016 on public procurement,

- other supporting documents, as the case may be.

If in the country of origin or the country in which the bidder / third party supporter / subcontractor is established, no documents of the nature of those mentioned above are issued or those documents do not cover all the situations provided in art. 177, 178 and 180 din Law 99/2016, the contracting entity has the obligation to accept a declaration on its own responsibility or, if in the country there are no legal provisions regarding the declaration on its own responsibility, an authentic statement given before a notary, an administrative or judicial authority or a professional association that has competence in this regard.
