EW Dychow Compass vibration diagnostics system

The subject of the contract is the performance of the task for the Employer under the name "EW Dychow Compass vibration diagnostics system." The contract includes delivery, installation and launching the Compass 6000 or equivalent vibration diagnostics system (equivalence parameters have been specifiedthey are in Annex 2 to the OPZ). The system includes 3 hydro sets and 4 pumps installed in ESP Dychow. The order will be carried out according to the documentation provided by the Employer.

The subject of the contract is to perform for the Employer a task under the name "EW Dychow System"Compass vibration diagnostics." The order includes the delivery, installation and commissioning of a Compass 6000 or equivalent vibration diagnostics system (equivalence parameters are detailed in Annex 2 to OPZ). The system includes 3 hydroelectric units and 4 pumps installed in ESP Dychow. The order will be carried out according to documentation provided by the Employer.

Detailed Description Pthe subject of the Order is included in Annex 1 to the ToR.

1. Contractors who are not subject to exclusion from the contract award procedure may apply for the award of the Contract, on the basis of the conditions of art. 24 paragraph 1 with the exception of cases referred to in art. 24 paragraph 1 point 13 lit. d and point 14 of the PPA, if the person referred to in this provision has been convicted of an offense listedin art. 24 paragraph 1 point 13 lit. d (Article 133 (4) of the Public Procurement Law), which conditions occurred in the relevant period specified in Article 24 paragraph 7 of the Public Procurement Law and are not subject to exclusion pursuant to art. 24 section 5 points 1, 2 and 4 of the Act on Public Procurement Law

2. The contractor is obliged to submit the EAT statement with the offer. The offer and the EAT must be submitted electronically, the file must be accompanied by a qualified electronic signatureonicznym.

3. The Contractor, which refers to the resources of other entities, in order to demonstrate the lack of existence of grounds for exclusion and compliance with them, to the extent that it refers to their resources, the conditions for participation in the Proceedings, also submits the EAT about these entities.

4. Employer before awarding a contract whose value is equal to or exceeds the amounts specified in the issuing regulationsh pursuant to art. 11 paragraph 8 Public Procurement Law, will call the contractor whose offer has been rated the highest to submit it within a designated period not shorter than 10 days, valid on the day of submitting the statements or documents confirming the circumstances referred to in art. 25 paragraph 1 of the Public Procurement Law, the catalog of documents is specified in section VIII para. 7 SIWZ.

5. If it is necessary to ensure adequateof the course of the procurement procedure, the Employer may at any stage of the procedure request contractors to submit all or some statements or documents confirming that they are not subject to exclusion, meet the conditions for participation in the procedure, and if there are reasonable grounds to believe that previously submitted statements or documents are no longer valid, until submittedand current statements or documents, the catalog of documents is specified in section VIII para. 7 SIWZ.

6. Within 3 days of submitting the information referred to in art. 86 section 5 of the Public Procurement Law, the Contractor shall provide the Employer with a statement on belonging or not belonging to the same capital group as referred to in art. 24 paragraph 1 point 23 Public Procurement Law

7. - 7 and 8 of the Regulation of the Minister of Development withon July 26, 2016. regarding the types of documents that the Employer may request from the Contractor in the procurement procedure (Journal of Laws of 2016, item 1162) shall apply accordingly.

8. Consortium JEDZ documents, Statements constituting Annexes 4 and 7 to the ToR are submitted by each of the Contractors.

9. Contractor, which relies on the capabilities or situation of other entities, in accordance with art. 22a of the Public Procurement Law, by EATwith the documents referred to in paragraph and 3-4 above for these entities

10. The awarding entity shall apply the procedure described in art. 24aa uPzp

1. Contractors who meet the conditions for participation in the proceedings referred to in Art. 22 paragraph 1b point 2) of the Public Procurement Law, i.e. regarding the economic or financial situation, the Employer requires that the Contractor has creditworthiness orfinancial funds on the bank account for an amount not less than PLN 500, 000.00 (say: five hundred thousand zlotys).

2. In the case of Contractors jointly applying for the award of the Contract, the above conditions may be met by all Contractors jointly.

3. The contractor to confirm compliance with the conditions for participation in the procedure, where appropriate and in relation to a specific contractestablishment, may rely on the financial or economic situation of other entities, regardless of the legal nature of the legal relations with it.

4. The Employer also informs that the relevant situation referred to in paragraph 3 above, will occur only if:

1) The Contractor, which relies on the abilities or situation of other entities, proves to the contracting authority that realizing the contractie, it will have the necessary resources of these entities, in particular, presenting the undertaking of these entities to provide it with the necessary resources for the purposes of the contract;

2) The contracting authority will assess whether the technical or professional capacity made available to the contractor by the contractor allows the contractor to demonstrate compliance conditions for participating in the proceedings and will examine, cthere are no grounds for exclusion against this entity, as referred to in section VII of the ToR.

5. The Contractor, which relies on the financial or economic situation of other entities, is jointly and severally liable with the entity that has undertaken to make the resources available, for damage suffered by the contracting authority as a result of the failure to make these resources available, unless he is not responsible for the failure to make the resources available.

6. If the economic or financial situation of the entity referred to in para. 3, do not confirm the fulfillment by the contractor of the conditions for participation in the procedure or there are grounds for exclusion for these entities, the Employer requests that the Contractor replace the entity by another entity or entities within the time specified by the Employer or undertake to personally perform the relevant partof the contract, if it demonstrates the financial or economic situation referred to in para. 1

7. To confirm the initial fulfillment of the conditions, the Contractor is obliged to submit the JED (Single European Procurement Document) document and confirm the above information by a statement in Part IV in section α (alpha).

8. If the Contractor submits a document or statement in which it will be indicatedan amount in a currency other than PLN, then it will be converted to PLN according to the average NBP exchange rate as at the date of publication of the contract notice in the Official Journal of the European Union (in the absence of the average NBP exchange rate on the day following the date of publication of the contract notice).

2. The Contractor is obliged to submit a valid JEDZ statement valid as at the date of submission of offers constituting a preliminary confirmation that the Contractor is not subject to exclusion and meets the conditions for participation in the procedure.

3. In the scope of "part IV Eligibility criteria" EAT, the Contractor may limit himself to completing the "alpha" section, in which case the contractor shall not complete any of the other sections(A-D) in Part IV EAT.

4. The Contractor, who refers to the resources of other entities, in order to demonstrate the lack of existence of grounds for exclusion and compliance with them, to the extent that he refers to their resources, the conditions for participation in the proceedings, submits JEDZ also concerning these entities.

5. In the case of joint application for the Contract by the Contractors, EAT shall be submitted by each of these Contractors. Nplease send them in accordance with the rules set out in the ToR

6. If the Contractor has its registered office or place of residence outside the territory of the Republic of Poland, and also if the person to whom the given document relates is domiciled outside the territory of the Republic of Poland, the rules set out in - 7 and 8 of the Regulation of the Minister of Development of 26.7.2016 apply. on the types of ddocuments that the contracting authority may request from the contractor in the procurement procedure (Journal of Laws of 2016, item 1126, as amended).

7. The Contractor, within 3 days from the date of posting on the website the information referred to in Article 86 para. 5 of the Public Procurement Law, provides the Employer with a declaration of belonging or not belonging to the same capital group as referred to in art. 24 paragraph. 1 point 23 of the PPL Act

10. The offer binding period referred to in point IV.2.6) of the announcement is 60 days. The offer validity period begins with the submission deadline.

11. The contracting authority does not provide for the possibility of awarding contracts referred to in art. 67 section 1 point 6 of the Public Procurement Law

12. The procedure is conducted in an open tender pursuant to art. 39 in connection fromArt. 134ust. 1 of the Act of 29.1.2004 Public Procurement Law (i.e. Journal of Laws of 2018, item 1986, as amended).

13. The offer together with attachments, otherwise being null and void, is submitted electronically by submitting, through the PGE CG Purchasing System, a qualified electronic signature of persons authorized to submit it by the Contractor.

14. The contractor fills in the SystemPurchasing Capital Group PGE required by the Employer information and attach the documents and statements required in accordance with the ToR, and then sign the abovementioned document with Electronic signature.

15. Each of the required documents must be signed by an authorized person / persons with an electronic signature. Offers and statements, including a single document, shall be made, under pain of nullity, in the form of an electroand has a qualified electronic signature.

16. The offer should be made in Polish. Documents drawn up in a foreign language must be submitted together with a translation into Polish.

17. The awarding entity will use the procedure described in art when selecting the most advantageous offer. 24aa uPzp
