The way of accomplishment: The DUAE will be completed by each Associate / Tenderer / Subcontractor participating in the award procedure with the information related to their situation.
The supporting documents proving the fulfillment of the undertaken by completing the DUAE are to be presented, at the request of the contracting authority only by the ranked bidderon the first place in the ranking drawn up at the completion of the evaluation of the bids. These documents may be: a) The tax certificate issued by the Tax and Local Tax Department showing the lack of overdue debts at the moment of the presentation b) The fiscal attestation issued by the tax administration of the territorial administrative unit on the territory of which the company has its registered office(c) the judicial record of the economic operator and of the members of the administrative, management or supervisory body of that economic operator, or of those having the power to represent, decide or control within it, as it results from the certifying certificate issued by the ONRC / constitutive act; b)Where appropriate, documents demonstrating that the economic operator may benefit from the derogations provided in art. 166 par. 2, art. 167 paragraph 2 and art. 171 of Law 98/2016 on Public Procurement; c) Other editorial documents, as the case may be.

The supporting documents proving the fulfillment of the assumed by completing the DUAE shall be submitted, at the request of the contracting authority, only by the tenderer placed on the first place in the intermediary intermediary drawn up at the completion of the tenders. 1 If, following the establishment of the final ranking according to the award criterion, the evaluation commission finds that there are two or more offers, ranked I, have the same price, contracting authoritywill ask the economic operators concerned a new financial proposal through SEAP, on the basis of which they will be allocated. The economic operators concerned will submit through SEAP a new financial proposal (documents containing the new prices), on the basis of which they will be divided.
2.If the economic operator demonstrates that the criteria regarding thethe professional capacity of the professional activity, the economic and financial capacity, the technical and professional capacity and the standards of quality assurance and environmental protection invoking the support of a third party, or if the economic operator intends to subcontract a part / parts of the contract, the DUAE also includes information about the subc3. The economic operator shall specify the list of documents in the offer that are confidential, protected by an intellectual property right or commercial secret. The contracting authority reserves the right to terminate the framework agreement unilaterally before the deadline if the Ministry of Health will conclude framework agreements under GEO 71/2012as object of the present proceedings
