Requirement 1: bidders, third party supporters and subthe contractors must not find themselves in the situations provided by art. 164, 165, 167 of Law no. 98 / 2016.

Mode of accomplishment: DUAE will be completed in accordance with Art. 193 par. (1) of the Law no. 98 / 2016.

The supporting documents proving the fulfillment of the assumed by completing the DUAE shall be submitted at the request of the contracting authority / entity only by the tendererranked first in the intermediate rankings drawn up at the end of the evaluation of the bids are:

- certificates showing the lack of overdue debts, regarding the payment of taxes, duties or contributions to the general consolidated budget (local budget, state budget, etc.) the presentation,

the criminal record of the economic operator and the members of the management body, management or oversight of the respective economic operator, or those having the power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / constitutive act, - if necessary, documents by which it is demonstrated that the economic operator may benefit from the derogations provided for in art. 166 par. (2), art. 167 par. (2), art. 171 of the Public Procurement Law 98/2016, - other editorial documents, as the case may be.

If in the country of origin or the country in which the tenderer / third party / subcontractor is established no documents of the kind referred to above or those documents do not cover all the situations provided in art. 164, 165 and 167, the contracting authority / entity is boundto accept a declaration on his own responsibility or, if there is no legal provision in the country concerned on the declaration on his own responsibility, a genuine declaration given to a notary, an administrative or judicial authority or a professional association with powers in this respect sense.

Requirement no. 2: declaration of non-compliance with the situations stipulated in art. 59-60 of Law no. 98 / 2016.

The manner of compliance and the applicability in the procedure.

The manner by which the fulfillment of the requirement can be demonstrated: it will be completed by the economic operators participating in the award procedure with the information related to their situation. The supporting documents demonstrating the fulfillment of the undertaken by completing the DUAE are to be presentedat the request of the contracting authority, only by the tenderer ranked first in the intermediate rankings drawn up at the completion of the evaluation of the tenders.

Requirement no. 1: economic operators submitting a tender must prove a form of registration under the law of the resident country, showing that the economic operator is legally constituted, is not in any of the situations of cancellation of the establishment, and that it has the professional capacity to perform the activities covered by the accountpublic procurement / sector procurement. This requirement applies also to subcontractors and / or third-party supporters who fill in the information related to their situation at the level of a distinct DUAE.

Mode of accomplishment: will be completed by the economic operators participating in the procedure for awarding the public / sectoral procurement contract requested bycontracting authority / entity information regarding the fulfillment of the requirements regarding the capacity to exercise the professional activity.
