Requirement:

- The bidders, third parties and subcontractors must not find themselves in the situations stipulated in art. 164, 165, 167 of Law no. 98/2016,

- The bidders, third parties and subcontractors must not be found inthe situations provided in art. 59 60 of the Law no. 98 / 2016.

The manner by which the fulfillment of the requirement can be demonstrated: - - the DUAE (Single European Procurement Document) will be filled in by the economic operators / subcontractor / third party, the participants in the award procedure with the information related to their situation, will load into SEAP; -qualified statement confirming cthe economic operator is not in any of the exclusion situations mentioned in art. 59 60 of Law 98/2016, - will be filed with the DUAE in SEAP.

The decision-makers within the contracting authority are: Catalin Ion Besea, Vasile Iojiban, Cristian Rus, Emilia Raveca Salagean-Gancean, Nicolae Cosmin Grecu, Buhutan Gabriel, Bombica Gabriel, Plian Radu, Dan CristiThe supporting documents proving the fulfillment of the assumed by completing the DUAE are to be presented, at the request of the contracting authority, only by the bidder ranked first in the intermediate rankings drawn up at the completion of the evaluation of the offers (according to art. 66 of GD 395/2016 and art. 196 par. (2) of L98/1996], as follows:

- Certificate for the payment of local taxes and fees (certified copy with the mention "according to the original"), from which it appears that the tenderer has no overdue debts at the presentation date, - taxes and taxes to the state (certified copy with the mention "according to the original"), from which it appears that the bidder does not have theoutstanding attitudes on presentation date. Foreign legal / natural persons wishing to participate in the procedure will present any editorial documents issued by the competent authorities of the country in which they are resident, proving the fulfillment of outstanding obligations regarding the payment of taxes and social security at the moment their presentation

- the criminal record ato the economic operator and to the members of the management, management or supervisory body of the respective economic operator or of those who have the power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC /

- as the case may be, documents demonstrating that the economic operator can benefit fromthe eyewear provided in art. 166 paragraph (2), art. 167 par. (2), art. 171 of Public Procurement Law 98/2016, - other editorial documents, as appropriate.

Requirement: operators arecondominiums (associates, subcontractors or third claimants) submitting a tender must prove a form of registration in accordance with the law of the country of residence, that the economic operator is legally constituted, that he is not in any of the situations of cancellation of the establishment the fact that it has the professional capacity to perform the activities covered by the contract. Having regard to Article 44 (2) of Law 98/2016, "Where a procurement procedure is an organfully jointly, in the name and on behalf of all the contracting authorities referred to in paragraph (1), they shall be jointly and severally liable for the performance of their obligations under this Law. If two or more economic operators whose offers have been declared legally admissible, technical and economical-financial by the contracting authority, offered the pricesthe contracting authority will require only those operators to submit new price offers on the SICAP in the "Clarification" section. Economic operators have the right to improve the previously bid price and the offer containing the new lowest price will be declared the winner The bidder will submit a statement accepting the contractual clauses included in the tenderthe subsequent framework agreement / subsequent contract from the awarding documentation (otherwise it is considered his / her tacit consent). In the case of objections to the draft contract, these will be formulated in writing through the clarification requests respecting the deadlines stipulated by art. 161 of Law 98 / 2016.
