The general requirement of an official decision for the permissibility of the exercise of an activity in Austria as well as the obligation according to -- 20 and 188 paragraph 1 of the Federal Provisions Act 2006 is expressly pointed out. Sections 20 and 188 (1) of the Federal Procurement Act 2006 oblige applicants or tenderers who-are in the territory of another Contracting Party to the EEA Agreement or resident in Switzerland and are required to obtain an official decision concerning their professional qualifications to commence activities in Austria as soon as possible, or at any rate before the expiry of the time limit for the submission of tenders. For regulated trades (- 94 of the Gewerbeunnung. 1994), reference is made in this connection to -- 373a to 373e of the Trade Regulations 1994.
