In addition to the compulsory exclusion reasons in Sections 135 and 136 of the Offering Act, the voluntary exclusion reasons in section 137 of the Offering Act apply.

Aarhus Municipality is thus obliged to exclude a tenderer who is subject to the following voluntary grounds for exclusion (unless the tenderer can documentis its credibility under section 138 of the Tendering Act):

- The tenderer has failed to comply with current obligations in the field of environmental social or labor law, cf. section 137 (1) of the Tendering Act, or liquidity treatment, cf. - 137 (2) of the Offering Act,

- The Municipality of Aarhus may show that the tenderer in connection with the exercise of itsprofessions have committed serious negligence that casts doubt on the bidder`s integrity, cf. - 137 (3) of the Tendering Act,

cf. Section 137 (4) of the Tendering Act,

- The Municipality of Aarhus may show that the tenderer is materially at fault.held a previous public contract, cf. - 137 (5) of the Tendering Act,

- The Municipality of Aarhus may show that the bidder has unlawfully tried to influence the decision-making process of the Municipality of Aarhus, whose bidder has obtained confidential information that can give them unjust advantages in connection with the tender procedure, or if the tenderer has grossly negligently provided misleading information which may haveSignificant influence on decisions, cf. Section 137 (6) of the Tendering Act,

- The tenderer has paid unpaid debts of less than DKK 100, 000 to public authorities regarding taxes, fees or contributions to social security schemes in accordance with Danish law or legislation in the country, where the bidder is established, cf. section 137 (7) of the Tendering Act, cf. 4.
