Assignthe participant shall withdraw from participation in the procedure for which any of the circumstances under Art. 54, para. 1, Art. 55, para. 1, items 1, 3, 4, 5 and Art. 107 of the Public Procurement Act as well as a participant who does not meet the selection criteria set or fails to fulfill another condition specified in the public procurement contract or in the documentation, or who has submitted a tender which does not correspond to the previously announcedthe terms and conditions of the order and in any way included any part of its offer outside the "Price Parameters" envelope related to the price offered and / or parts of it The Contracting Authority will remove from participation in the tendering procedure whose implementation proposal of the order does not fulfill all the conditions of the technical specification, has not submitted in due time the justification under Article 72, paragraph 1 othe PPA or its offer was not accepted according to Art. 72, para. 3-5 of the PPA as well as when in its price proposal it has indicated a total value excluding VAT for the execution of the order which exceeds the total estimated value specified in section II.1.5 of the contract notice and / or has made an arithmetical error or an error in the rounding of the price proposal. When a participant in the procedure is a union, whicho is not a legal entity, a copy of the document shall be required showing the legal basis for the formation of the grouping, as well as the rights and obligations of the members of the grouping, the distribution of responsibility among the members of the grouping, the activities to be performed by each member of the grouping unification in connection with this public procurement. The guarantee for the execution of the generalThe original order is 5% (five percent) of its value excluding VAT. The Contracting Authority determines that 20% of the performance guarantee serves to ensure warranty maintenance on the subject matter of the order.
