1. Proceedings for granting a public order are conducted in an unlimited tender on the basis of Art. 39 of the Act of 29.1.2004. Public Procurement Law (i.e. - Journal of Laws of 2018).

Main Site: The place of the order is the Agricultural Schools. Wincenty Witos in Ostrożany, Ostrożany 41, 17-312 Drohiczyn, Powiat Siemiatycki, POLAND

1. Delivery of equipment for didactic laboratories. The delivery includes nutrition planning workshops, a consumer service workshop and a gastronomic studio in the Agricultural School Complex in Ostrożany.

Detailed scope of the subjecton orders and a physical and quantitative list of equipment for individual laboratories is indicated in Annex 1A to the ToR and Annex 1A.1 - "Gastronomic Workshop" and Annex 1A.2 - "Customer Service Workshop" show the projection of the studio rooms with an indication of the location and location of the required equipment in these workshops (auxiliary drawings)

2. Contractor within remunerationIn particular, it is obliged to fulfill the following benefits for the Employer: a) supply the equipment with its own transport and at its own expense and risk to the place of performance (school), b) unload the Equipment from the means of transport and transport it, bring it to the ones indicated by School headmaster, unpacking, deployment and if applicable:

- assembly / installation of connection and configuration of delivered machines and devices at designated positions in the headquarters,

- start-up and first start-up,

- training of persons indicated by the Employer,

- removal of any damage, contamination, export of packaging, etc. at their own expense, - before the collection,

c) as part of the execution of each part of the order, compliantNot with the provisions of this ToR and contract concluded for the execution of this part of the contract, the Contractor will be obliged to use: his own resources, own effort and at his own expense (without the need to purchase additional elements by the Ordering Party): - installation and configuration of the software on the delivered devices which require, - run and test accessmachines and devices in the range ensuring their proper operation and use, in accordance with the purpose and requirements of the Employer,

d) providing service as part of the quality guarantee on the terms specified in the model contract.

3. The contracting party provides for the possibility of "Reversed procedure" referred to in Article 24aa (1) of the Public Procurement Law

1.no orders, call the contractor whose offer has been assessed at the most, to submit in a period not shorter than 10 days, valid as of the day of submitting statements or documents confirming the circumstances referred to in Article. 25. para. 1 point 3 of the Public Procurement Law, ie: -1) information from the National Criminal Register in the scope specified in art. 24 sec. paragraph. 1 items 13, 14 and 21 of the Public Procurement Law, exhibitionsnot earlier than 6 months before the deadline for submitting bids in the proceedings,

2) excerpt from the relevant register or central records and business information, if separate regulations require entry in the register or records, to confirm the absence of grounds for exclusion under Article . 24 sec. 5 point 1 of the Act;

3) the Contractor`s statement about the lack of a decision against himas a precautionary measure, a ban on applying for public orders; - 4) a statement by the economic operator about the lack of a final court judgment or final administrative decision on default of taxes, fees or social security or health insurance premiums, or - in the event of such a sentence or decisions - documents confirming the payment of thesereceivables with possible interest or fines or a binding agreement regarding the repayment of such receivables.

2. If the contractor has its registered office or place of residence outside the territory of the Republic of Poland, instead of the documents referred to in point 1. point 1) and 2):

1) point 1) - submit information from the relevant register or, in the absence of such a register, another equivalent documentent issued by the competent judicial or administrative body of the country in which the contractor has its registered office or place of residence or the place of residence of the person concerned by information or a document within the scope defined in art. 24 sec. 1 item 13, 14 and 21 of the Public Procurement Law,

2) point 2) - submits a document issued in the country in which the contractor has its registered office or place of residence, confirming respectively thatits liquidation was not opened and bankruptcy was not announced. The documents referred to above should be issued not earlier than 6 months before the deadline for submission of tenders. If in the country in which the contractor has its registered office or place of residence or place of residence has a person to whom the document applies, no documents referred to in paragraph 2 are issued, they are replaced by a documenta statement of the contractor, indicating the person or persons authorized to represent it, or a statement of the person to whom the document was related, submitted to the notary or before a judicial, administrative or professional self-regulatory or economic authority competent for the place of residence or place of residence of the contractor or place; residence of that person. Recipethe second sentence referred to in point 2 shall apply.

4. The Contractor having its registered office on the territory of the Republic of Poland, in relation to a person residing outside the territory of the Republic of Poland, which is referred to in the document indicated in point 1 point 1), submits the document referred to in point 2 to the extent specified in art. 24 sec. 1 points 14 and 21. If in the country where the residence is locatedboth of which the document was to concern, such documents shall not be issued, it shall be replaced by a document containing a statement of that person made before a notary or before a judicial, administrative or professional self-regulatory or economic self-regulatory body. The recipe indicated in point The second sentence of the second sentence applies.

1. In the proceeding is requiredpayment of the bid bond. If the Contractor submits an offer for more than one part, the bid bond should be paid in the amount of the total sum of wades in all parts for which the offer is made (ie the amount of the bid bond is the sum of amounts specified for each part for which the offer is made) . Before the deadline for submission of tenders, the Contractor is obliged to submit a tender guarantee, on timefor the period of validity of the offer in the amount of: - Part I PLN 23, 000.00 euros: (twenty three thousand zlotys) - 2) Part II PLN 11, 000.00 euros: (eleven thousand zlotys) - 3) Part III 15, 000.00 PLN fifteen thousand PLN) before the deadline for submission of offers. Details of the deposit payment are described in Chapter XII SIWZ.

2. The Contractor shall be excluded from the public procurement procedure in relation to dwhich happens any of the circumstances referred to in art. 24 sec. 1 and in art. 24 section 5 point 1 of the Public Procurement Law

3. For the purpose of preliminary confirmation of the lack of grounds for exclusion, the Contractor / s submits an appropriate statement in the Single European Order Document, which he prepares only in electronic form and provides a qualified electronic signature.

4. Contractor on time3 days from posting information on the website referred to in art. 86 par. 5 of the Public Procurement Law, is obliged to provide the Employer with a declaration of belonging or non-affiliation to the same capital group as referred to in art. 24 sec. 1 point 23 of the Act with entities that submitted bids in the proceedings. Along with the submission of the statement, the Contractor may provide evidence thatconnections with another contractor do not lead to distortion of competition in the procurement procedure. The statement should be submitted in electronic form with a qualified electronic signature. Information referred to in art. 86 par. 5 of the Act and the proposed content of the above-mentioned statement, the awarding entity will place immediately after opening the offers on the website at www.bip.st.siemiatycze.wrotapodlasia.pl

5. In addition, the offers are requested by the Employer if applicable:

1) (optionally if applicable) a document confirming the payment of the bid bond (guarantee or surety, if it is paid in a form other than cash);

2) (optionally if applicable) power of attorney (see item 18 of the ToR below,

3) (optionally if applicable) document containing explanation and justification, dthe combined information constitutes the trade secret (see Chapter XI, paragraph 16, SIWZ).

6. In case of signing the offer by a qualified electronic signature or a confirmation of compliance with the original of an electronic copy of the document / statement and affixing it with a qualified electronic signature, by a person not mentioned in the excerpt from the relevant register or central registerand information about economic activity of the Contractor, the offer must be accompanied by appropriate power of attorney in the original, in the form of an electronic document with a qualified electronic signature or in an electronic copy certified as true copy and bearing a qualified electronic signature by a notary public. Communication between the Employer and Contractors, inSpecifically, the submission of offers, statements, including statements made on the EAT form, takes place using means of electronic communication, i.e. using:
