1. The subject matter of this order is the successive provision by the Contractor to the Ordering Partyhim maintaining services in full technical efficiency and removing irregularities in the work of the integrated security system, being the property of the Employer (hereinafter referred to as "Services" or "Subject of the orders").

1. As part of the Services, the Contractor will be obliged in particular to

1) Perform actions:

a) Repair - such as identification and location Hardware or software irregularitiesm) and maintenance or repair of defective components of the Systems;

b) maintenance and maintenance, such as performance of system overviews or their components specified in Annex 2 to OPZ;

c) maintenance such as hardware and software modifications and changes in the functionality of any of the Systems and updates Systems provided by the equipment manufacturer orSystem

The detailed list of infrastructure elements covered by the Services along with their location is presented in Appendix No. 1 to OPZ.

2) The Contractor should perform the Services whereas the Systems built on the PKM line are under the guarantee of the Guarantor throughout the duration of the Agreement constituting Annex No. 7 to SIWZ.

3) The purpose of the order is to ensure uninterrupted maintenance in full efficiency of eachsystems and their components as well as preventing the occurrence of Irregularities. Maintenance is intended to minimize the operational difficulties resulting from the occurrence of anomalies.

4) The Contractor shall provide the Services in 24h / 365 days with the following response times to the occurrence of Irregularities:

a) up to 4 hours for Critical failure,

b) up to 24 hours-in the case of an Urgent Failure,

c) up to 7 days in the case of Fault.

5) The provision of services does not include:

a) repairs and modernization of Systems,

b) specialist tests, expert opinions, etc.

The above works may only be carried out under separate agreements that are the subject of separate proceedings.

2. Wherever, when describing the subject of the order, standards, approvals, technical specifications are set up andreference systems, or trademarks, parameters or sources of origin (names of producers or devices), these provisions should be treated as examples, and the Contractor always has the right to apply the equivalent solution with the proviso that the proposed equivalence solutions must meet at least the design assumptions. In this situation, the Employer requires submissionrelevant documents to authenticate the equivalent solution.

3. Other regulations regarding the subject of the Order are described in the detailed description of the subject of the order (hereinafter referred to as OPZ) constituting Annex No. 1 to the Terms of Reference and the contract template constituting Annex No. 7 to the Terms of Reference, on the terms and conditions that the Contractor is obliged to fulfill the order. starchthose specified in the OPZ are applicable in the content of this ToR.

4. Additionally, the Ordering Party informs that:

1) The Ordering Party does not allow the possibility of submitting variant bids.

2) The Ordering Party does not allow the possibility of submitting partial offers.

3) The Ordering Party does not provide for the award of contracts referred to in - 57 subpara. 6 of the Regulations.

4) Settlements between the Employer and the Contractor were carried outthey will be in PLN.

5) The proceedings are conducted in Polish.

6) The contractor may entrust the execution of a subcontractor's part of the order. In such a situation, the Contracting Authority requires the contractor to indicate part of the orders that he intends to entrust with the subcontractors, and the contractor to submit subcontractors. It is assumed that no indication of Subcontractors means that the Contractor will not entrust the executionno part of the orders to subcontractors if nothing else results from the offer.

1. The Awarding Entity does not specify the conditions for participation in the proceedings referred to in - 13 para. 1 point 1) and 2) of the Regulations, regarding the economic or financial situation and competences or entitlements to conduct a specific professional activity, if it results from separate provisions.

2. In the proceedings they canparticipate in the Contractor who meets the condition of participation in the proceedings, regarding the lack of grounds for exclusion from the public procurement procedure in the circumstances referred to in - 15 para. 1 of the Regulations.

3. The Employer also foresees exclusion from the subject proceedings of the Contractor: pursuant to - 15 para. 2 points 1 of the Regulations

4. The Contracting Party informs that in the first consecutivewill assess the offers in terms of the conditions for the rejection of the offer in accordance with - 70 of the Regulations, and then using the right referred to in - 19 subpara. 1 of the Regulations of the offer that are not subject to rejection will be assessed in terms of the criteria specified in the Terms of Reference, and then will examine whether the Contractor whose offer has been evaluated as the most advantageous, is not subject to exclusion and meets the conditions for participation inproceedings.

5. In order to confirm compliance with the condition of participation in the procedure, the Contractors should submit an offer valid at the day of submitting bids in the scope indicated in Appendix No. 3 to the ToR.

6. To confirm that there are no grounds for exclusion, the Bidders should submit a valid statement as of the day of submitting bids in the scope indicated in Appendix No. 3 to the ToR.

7.At the request of the Employer referred to in - 20 para. 1 of the Regulations, in order to confirm the circumstances referred to in - 16 para. 1 point 3) of the Regulations, the Contractor shall submit a copy from the relevant register or central records and information on economic activity, if separate regulations require an entry in the register or records, in order to confirm the lack of grounds for exclusion under - 15 para.2 point 1) of the Regulations, subject to paragraph 8 SIWZ;

8. The Contractor, within 3 days of the date on which the information on the opening of offers is published on the website, provides the Employer with a declaration of belonging or non-affiliation to the same capital group as referred to in - 15 para. 1 point 12 of the Regulations. Along with the submission of the statement, the Contractor may provide evidence that the connections with otherscontractors do not lead to distortion of competition in this proceeding. The pattern of the declaration is attached as Annex 6 to the ToR.

9. Documents submitted by foreign contractors:

1) If the Contractor is established or resides outside the territory of the Republic of Poland, instead of the documents referred to in Chapter VI, paragraph 5 above, submit a document or documents issued in the country whereOrym has its registered office or place of residence, confirming that it has not been liquidated or that bankruptcy has been declared.

2) The document referred to in Chapter VI, paragraph 14 point 1 of the SIWZ should be issued not earlier than 6 months before the deadline for submitting offers.

3) If in the country in which the contractor has a registered office or place of residence has a person whose-the document refers to, no documents referred to in point 2 are issued, they are replaced by a document containing the contractor's statement, indicating the person or persons authorized to represent it, or a statement of the person to whom the document was related, filed before a notary or before a judicial authority, administrative or professional self-regulatory or economic self-governmentdue to the seat or place of residence of the Contractor or place of residence of that person. The provision of point 2 applies accordingly.

10. Other regulations regarding declarations or documents to be provided by the Contractor to confirm compliance with the conditions of participation in the proceedings and no grounds for exclusion have been included in Chapter VI of the ToR -
