Performing research on the bottom of the basin to determine the presence of objects that could bethreaten people and equipment (explosive and dangerous objects) in the Kashubian Basin and the Dębicki Canal in the Port of Szczecin. The task covered by the subject of the order is one of the elements of preliminary work - preparatory to the implementation of the investment named "Improvement of access to the port of Szczecin in the vicinity of the Kashubian Basin" and "Improvement of access to the port of Szczecin in the area of the Dębicki Canalego "implemented under the Operational Program Infrastructure Environment 2014-2020. The subject of the order is to perform a ferromagnetic intelligence survey of magnetic scanning together with Reports for the needs of implementation of the aforementioned projects. Direct investigation (disclosure under water) and mining of these objects are not the subject of this order.

Taskcovered by the subject of the order is one of the elements of preliminary work - preparatory for the implementation of the investment named "Improvement of access to the port of Szczecin in the vicinity of the Kashubian Basin" and "Improvement of access to the port of Szczecin in the vicinity of the Dębicki Channel" implemented under the Operational Program Infrastructure Environment 2014-2020. Final reports from tests carried out under thisthe orders will be used as one of the elements of the description of the subject of the order in a separate tender for the execution of hydrotechnical, construction and dredging robots, planned to be carried out as part of the investment. In order to ensure the safety of the work, the contracting party intends before starting any work in the area and on the basin of the Kashubian Basin and the Dębicki Canal related to the construction of a newhydrotechnical objects, locate all ferromagnetic objects that can be potentially dangerous objects, especially military origin. Direct research (disclosure under water) and mining of these objects is not the subject of this order. As part of this order, the area of planned works (bottom of the basin) should be examined for the occurrence of objectsferromagnetic, in order to enable the future contractor of a deepening and hydrotechnical robot to estimate the risk of encountering dangerous objects of military origin and to determine the possible outlays necessary for their disclosure and removal. Magnetic scanning tests carried out and reports on the tests carried out (constituting the subject of this order) in the Ka Ka areaSzubski and the Dębicki Canal will enable the Port of Szczecin and Świnoujście S.A. commissioning of contractor works related to the reconstruction of existing or construction of new hydrotechnical facilities. The areas covered by the contract are located in the area of the Kaszubski Basin near Gdańska Street. The areas covered by the investment are entirely internal port areas, for which admission is exclusivee authorized persons. As part of the project, the access to the port will be improved by dredging works at the Katowicki and Chorzowski quays, as well as on the turntable, the approach track between the turntable, the Kashubian Basin and the marina on the Dąbrowiec Quay. The aim of the dredging robot is to obtain the technical depth Ht = -12.5 m at the above-mentioned objects. naythe magnetic scan should be carried out in the bottom of the area specifying scope of dredging robot in the area of reconstructed hydrotechnical objects to the shoreline designated by these buildings. The entire area of the Kashubian Basin under this order has been shown in the Situational Plan of the Kashubian Basin (Annex No. 1 to OPZ) and covers areas with a total area of approx. 36.4-ha.

The Ordering Party provides for the ordering of similar services under the part of orders in the scope of: • carrying out ferromagnetic measurements;

• describing and interpreting the results of ferromagnetic measurement;

• developing a Final Report on ferromagnetic research;

Not more than 20% the value of a part of the basic order.

The orders will beimplemented depending on the needs and financial resources that the Ordering Party will have, on terms specified in the Regulations of procurement co-financed from the funds of the European Union.

1. The Contractor may perform the subject of the contract with his own resources or with the help of subcontractors. If the Ordering Party intends to entrust the execution of a subcontractor's part (s) during the execution of the orderThe Ordering Party requests that the part of the order is indicated in the offer and the Subcontractor is submitted by the Contractor. Entrusting the execution of a part of the order to subcontractors does not relieve the Contractor from the responsibility for the proper performance of the order. Entrusting the execution of individual parts of the contract to subcontractors requires the conclusion of binding agreements with subcontractors containing at least: - the scope of entrustingpart of the subject of the order, - deadline for execution, which can not be longer than the due date assigned to a given part of the subject of the order, - regulation of copyrights in accordance with the provisions of the contract. The Contractor shall submit to the Ordering Party certified true copies of the contracts with subcontractors within 7 days of their conclusion. If the change or resignation from the subcontractor concerns the entity, nand whose resources the Contractor invoked in order to demonstrate the fulfillment of the conditions for participation in the proceedings, the Contractor is obliged to demonstrate to the Employer that the proposed other subcontractor or Contractor meets them to the extent not less than required during the procurement procedure. The Contractor may rely on abilities to confirm compliance with the conditions of participation in the proceedings-technical or professional situation or the financial or economic situation of other entities, regardless of the legal nature of the legal relations that it has in conjunction with it. The Contractor, which relies on the capacities or situation of other entities, must prove to the orderer that while executing the order, he will have the necessary resources of these entities, in particular by presenting the entity's obligationsow to give him the necessary resources to fulfill the order. With regard to conditions relating to education, professional qualifications or experience, contractors may rely on the capacities of other entities when they perform services to which these capabilities are required. Contractor, which relies on the financial or economic situation of other entitiesow, is jointly and severally liable with the entity that committed to provide resources, for damage suffered by the Employer arising as a result of not sharing these resources, unless the failure to provide access to resources is not at fault.

3. The Awarding Entity rejects the offer in cases specified in art. 89 Public Procurement Laws

4. The ordering party annuls proceedings after the occurrence of the premises mentioned in art. 93 of the Act-The PPA.

5. The ordering party may close the proceedings (in one or both parts) at each of its stages, without choosing any of the offers. Contractor who submits an offer for both parts of the order: - declaration on the lack of grounds for exclusion according to the template constituting Annex 3 to the Terms of Reference - submit one statement, - statement on the fulfillment of the conditions for participation in the procedure according to the formula-constituting Annex No. 4 to the Terms of Reference - submit a statement separately for each part, - information from a bank or cooperative savings and credit bank - submit one document, - list of services performed according to the template constituting Annexe No. 5 to the ToR - submit one declaration, - list persons according to the template constituting Attachment 6 or 7 to the Terms of Reference - submit a statement separately for each part• Contracts may be awarded to Contractors who meet the conditions for participation in the economic and financial situation. The Contracting Authority will consider that the contractor who submits an offer for one part of the order is in an economic and financial situation to ensure the execution of the order, if the contractor shows that he has funds on the account or creditworthiness in the amount of-a minimum of PLN 50, 000. The contracting authority will consider that the contractor who submits the tender for two parts of the order is in an economic and financial situation to ensure the execution of the contract, if the contractor shows that he has funds on the account or creditworthiness in the minimum amount of PLN 100, 000. along with the offer is obliged to submit valid for the daysubmitting statements and / or documents confirming fulfillment of the conditions for participation in the proceedings regarding the economic and financial situation ensuring the execution of the order, i.e. information of the bank or cooperative savings and credit union, confirming the amount of funds owned by the Contractor or the creditworthiness of the Contractor in the period not earlier than 1 monthbefore the deadline for submission of offers. The information should result in a specific amount in PLN.

In the case of the joint offer mentioned above. the document is submitted by the Contractor who demonstrates fulfillment of the condition. The contractor who submits the offer for both parts of the order submits one document.

Ww. the document should be submitted in the original or a copy certified as conforming to the original.

Evaluation of compliance with the conditions of participation in the progresswill be based on the content of submitted documents, evidence and statements. The Employer will assess the fulfillment of the conditions for participation in the procedure by the "fulfilling does not meet" method.

In the case when the amounts in the documents submitted by the Economic Operator will be expressed in a currency other than PLN.and the value of these amounts from foreign currencies into PLN using the average NBP exchange rate as at the date of publication of the contract notice in the Official Journal of the European Union. In the case when the NBP did not publish average exchange rates on the day the proceedings were initiated, the Employer will accept the first average exchange rate published after that date NBP.

The obligation of the third party, in accordance withChapter VI, para. 7 point 2) SIWZ, if the contractor intends to rely on the financial or economic situation of other entities to confirm compliance with the conditions of participation in the proceedings. the statement should be submitted in the original.

The estimated value of the orders does not exceed the amount specified in the regulations issued on the basis of Article 11 (8) of the Public Procurement Law. Pursuant to Article 133 (1), and sector orders, the act applies if the value of the order is equal to or exceeds the amounts specified in the regulations issued on the basis of art. 11 para. 8.
