Providing sanitary materials specific for patients with dystonia, specifications and quantities of the specification. The contracting authority will respond clearly and completely to all requests for clarification / information supplementon the 10th day before the deadline for submitting bids. The economic and financial situation of the economic operator participating in the award procedure of the acquisition contract publish, respectively the global turnover on the ultthree years - 2015, 2016 and 2017. Demonstration of the economic and financial situation is accomplished by completing the corresponding requirement in the DUAE form in the awarding documentation. The bidders will prove that over the past 3 years (2015, 2016, 2017) they have achieved a global average turnover that is at least equal to the estimated value of the largest subsequent contract for eachhas a lot. The turnover value in euros will be determined on the basis of the average RON / EUR exchange rate communicated by the National Bank of Romania for the respective year, as follows:

- average RON / EUR 2015 = RON 4.4450, - average RON / EUR 2016 = 4.4907 RON,

- the average rate RON / euro 2017 = 4.5229 RON.

The leader of the association, alone or together with associations and third party supporters (as the case may be) must ensurethis average of global turnover. For the equivalence of a declared turnover in a currency other than RON and Euro, the annual average RON / currency exchange rate communicated by the NBR will be used. The average level of turnover was established according to the estimated value of the largest subsequent contract and taking into account the provisions of art. 175 par. (2) lit. a) and art. 180 par. (1) of the Act-no. 98 / 2016.

Considering that the contracting authority will sign the framework agreement with economic operators(1) If the commission finds that more than two admissible offers have been filed / entered into the SICAP, the following shall be placed in the first, second and third place, as the case may be: equal scores to the tenderers classified in 1, 2 and 3, the contracting authority will send via SICAP a request for clarification regarding the submission of thenew improved financial proposals (2 decimal places) and economic operators will send their answer using the facilities offered by SICAP, in which case the contract will be awarded to the lowest bidder. In the case of maintaining equality and after the first request for clarification regarding the submission of new improved financial proposals in the SICAP, the current SICAP will again send a new clarification request through the SICAP regarding the submission of new improved financial proposals (with 2 decimal places). In the event of equality and following a second request for clarification regarding the submission of new financial proposals improved in SICAP, the award procedure for the respective lot is canceled. Deadlines / dates ofsubmission of new financial proposals will be communicated in the request submitted by the contracting authority. Without prejudice to the provisions of Law no. 182/2002 on the protection of classified information, with subsequent modifications and completions, the economic operator shall specify in the submitted offer the information contained in the technical proposal and in the financial proposal considered to beon-the-spot, classified, protected by an intellectual property right to the extent that the disclosure of such information would objectively prejudice the legitimate interests of the economic operator, particularly as regards commercial secrecy and intellectual property.
