The selection of a general contractor for the construction of 5 solar installations PV Pierzchały, PV Czernikowo, PV Samolubie 1, PV Samolubie 2 and PV Przykona, each installation is a separate project

1. The subject of the contract is the selection of a general contractor for the construction of 5 complete photovoltaic installations PV Pierzchały, PV Czernikowo, PV Samolubie 1, PV Samolbie 2 and PV Przykona, of which each installation is a separate project. As part of the order, the Contractor will be required to supply, install, commission and service solar farms with given installed capacities.

1. The subject of the contract is the selection of a general contractor for the construction of photovoltaic installations Part I PV Pierzchały; as part of the contract the Contractor withwill be required to supply, install, commission and service photovoltaic power plants with a given installed capacity:

PV Pierzchały approx. 702 kW.

The scope of the order includes in particular:

- reprofiling of the area,

- execution of the necessary construction and executive design, replacement construction design (if necessary) and detailed designs with their agreement in the scope ofas specified in the tender documentation,

- execution of necessary instructions together with their agreement,

- performance of necessary construction works,

- delivery of new equipment, structures, wiring,

- assembly of cables, equipment, structures, as-built measurements, tests and commissioning,

- preparation of as-built documentation with surveying,

- cutting down trees and shrubs at the construction site (if necessary).

2. Sa detailed description of the subject of the order is included in Annex 1 to the ToR.

3. The Awarding Entity allows submitting an offer for 1, several or all parts indicated in section II.1.4.

4. The Contractor is obliged to carry out the contract on the terms and conditions described in the draft contract constituting Annex 8 to the ToR.

5. The Purchaser requires the supply and use of only new equipment, manufacturednot earlier than 18 months before the date of the first generation of electricity in the installation in question.

Contractors who may apply for the Contract who: 24 paragraph 1 point 12 23 subject to art. 133 section 4 of the Act and pursuant to art. 24 paragraph 5 points 1, 4 and 8 of the Act.

To confirm that the Contractor has met the conditionsdescribed above, the Contractors submit together with the offer a single European order document in electronic form in accordance with the principles set out in chapter XII of the ToR. The Contractor who submits the highest rated offer will be invited to submit, within a period of not less than 10 days, valid as at the date of submitting the statements or documents confirming the fulfillment of the conditions for participation in the procedureu, on the terms and to the extent indicated in chapter XII of the ToR. In frontIn the case of a consortium, it is allowed to sum up the resources or creditworthiness of individual members of the consortium.

In order to confirm that the Contractor meets the conditions described above, the Contractors submit together with the offer a single European order document in electronic form in accordance with the principles set out in Chapter XII of the ToR. Contractor who submits the highest rated offer, will be invited to submit, within a period of not less than 10 days, valid as at the day of submitting statements or documents confirming the fulfillment of the conditions for participation in the procedure, on the principles and to the extent indicated in chapter XII of the ToR.

1. In the event that the Contractor attaches documents containing amounts expressed in currencies other than evil to confirm compliance with the conditions for participation in the procedureyou Polish, the Purchaser will convert them into Polish zlotys. For conversion, the average NBP exchange rate applicable on the day of publication of the announcement of the said Order in the Official Journal of the European Union will be used.

In the absence of publication of NBP exchange rates applicable on the day referred to above, the last published exchange rates before day, in accordance with - 8 point5 of Resolution No. 51/2002 of the Management Board of the National Bank of Poland of September 23, 2002 regarding the method of calculating and announcing the current exchange rates of foreign currencies (consolidated text of the National Bank of Poland from 2017 item 15).

2. Evaluates compliance with the conditions required of Contractors, will be made according to the formula "0-1", i.e. "meets / does not meet", based on documents and statements attached to the offer. With attached contentdocuments must clearly show that the Contractor meets the required conditions.

3. Documents drawn up in a foreign language must be submitted together with their translations into Polish.

When ordering, the Contractor shall require the Contractor to submit a Polish translation of the documents indicated by the Contractor and documents downloaded by the Employer.

5. The use of the purchasing platform by the Contractor is free of charge.

6. Binding period 60 days.

7. The Awarding Entity allows the possibility of extending the bid submission deadline if the auction deadline is changed, as referred to in Chapter XXV item 1 of the ToR.
