Achiziția de infrastructură ITthe following documents and forms will be presented: • The tenderer / associated bidder, the supporting third party and the subcontractor must not find themselves in the situations stipulated in art. 58 63, art. 164, 165, 167 of Law no. 98/2016 on public procurement. The failure to fulfill the assumed obligations is done by completing the DUAE following the request of the contracting authority to be filedsupporting documents related to those undertaken by completing the DUAE, only by the bidder ranked first, as a result of the result obtained following the completion of the electronic auction.

These documents may be:

1) Certificates confirming the payment of taxes and duties to the general budget the state and the local budget from which the overdue debts at the moment of presentation were to occur. Note:

The contracting authority will exclude from the procedure any tenderer / ofjoint venture / third party / subcontractor falling within the situations referred to in art. 58 63, art. 164, art. 165 and art. 167 of Law no. 98/2016. The DUAE will be completed, according to art. 193 of Law no. 98 / 2016.

Where appropriate, bidders will present with the DUAE a list of third party identification data / subcontractors, in order to comply with the provisions of Art. 63 alin. (2) of Law 98 / 2016.

The following documents will be filed with the DUAE: the firm's firm commitment of the third party, which will show the effective manner in which its support, subcontracting agreement and / or agreement will materialize of association, as the case may be.

The failure to submit them together with the DUAE is the basis for requesting clarification of any inadvertent• All documents requested by the contracting authority will be submitted by the tenderer by electronic means in SEAP, signed with the extended electronic signature based on un qualified certificate, according to the Law no. 455/2001, republished, regarding the electronic signature. Documents issued in a language other than Romanian will be presented in the language in which they were issued, accompanied by an authorized translation in Romanian. All documents will include, in addition to the signature, the full name of the signatory clearly.

Presentation of the certifying certificate emis from the Trade Registry Office, stating that the tenderer is authorized to carry out activities similar to those covered by this procurement (the object of the contract must have a correspondent in the CAEN code of the certifying certificate issued by ONRC). If the bidder demonstrates the fulfillment of the location criteriaeconomic and financial based on the capabilities of other entities, invoking, as the case may be, the support of a third party, the DUAE, together with the supportive commitment, must be filled separately by the supporting third party (s) on whose capacity it is based the average bidder for the last 3 years (2015, 2016, 2017) to be at least 19 435 176.47 RON, excluding VAT. If a group of economic operators submit a joint offer, then the economic and financial situation is demonstrated by taking into account the resources of all the members of the group applying the provisions of art. 31 par. (3) of Government Decision 395/2016. 1) An economic operator may participate in the procedure only if he / she is registered in SEAP 2) Correspondence and all documents submitted by economic operators will be in Romanian or accompanied by authorized translation in Romanian 3) Documentation of the award shall be placed in full in the tender notice published on the website www.e-licitatie.ro; 4) Requests for clarification ofthe potential bidders will exclusively address SEAP in the "Questions" section of the award procedure conducted by electronic means; 5) The answers to the clarification requests will be posted within the "Documentations, clarifications and decisions" of the participation announcement published on the website www.e-licitatie.ro; 6) The evaluation commission will send the requestclarification of the submitted offers in the SEAP in the "Questions" section The economic operators will send the answers to the clarifications and any documents requested during the evaluation of the offers through SEAP (the "Questions" section), fully in the section corresponding to the respective request, in the form of one or multiple signed signed / signed documents / files7) In order to demonstrate the fulfillment of the qualification criteria provided in the acquisition data sheet, the tenderer has the right and the obligation to initially submit only the Single European Document (DUAE) by accessing the following link: https://ec.europa.eu/ growth / tools, databases / ESPD / filter. - For viewing the award documents available on SEAP, an application must be used to open and verify any type of electronically signed document regardless of the provider of the certificate and the application with which the documents were signed, subject to compliance with the Electricity Submission Law 455/2001nica,
