Non-compliance with the provisions of art. 164 of Law no. 98/2016 (leader, associate, third party, subcontractor)

Mode of accomplishment: • The sole bidder / associated offeror / subcontractor / third party must prove that they do not meet the provisions of art. 164 ofLaw no. 98/2016. The manner by which the fulfillment of the requirement can be demonstrated: it will be completed by the economic operators participating in the preliminary award procedure with the information related to their situation, according to the provisions of art. 193 par. (1) of the Law no. 98/2016. The requirement for non-compliance with the situations provided in art. 164 also addresses to associates / subcontractorssuspects and third parties, according to art. 170 par. (1) and art. 183 par. (1) of the Law no. 98/2016, as amended and supplemented. The supporting documents proving the fulfillment of the undertaken by completing the DUAE are to be submitted, at the request of the contracting authority, only by the first ranked bidder in the intermediate rankings drawn up at the completionevaluation of tenders. Incorporation into one of the situations provided in art. 164 of Law no. 98/2016 entails the exclusion of the tenderer in the present proceedings. 2.

Non-compliance with the provisions of art. 165 of Law no. 98/2016 (leader, associate, third party, subcontractor)

Mode of performance: The sole bidder / associated offeror / subcontractor / third party must demonstrate thatdoes not comply with the provisions of art. 165 of Law no. 98 / 2016.

The manner by which the fulfillment of the requirement can be demonstrated: it will be completed by the economic operators participating in the award procedure, with the information related to their situation, according to the provisions of art. 193 par. (1) of the Law no. 98/2016. The requirement for non-compliance with the situations provided in art. 165shall also be addressed to the associates / subcontractors and to the supporting third parties, according to art. 170 par. (1) and art. 183 par. (1) of the Law no. 98/2016, with subsequent amendments and completions. The supporting documents proving the fulfillment of the assumed by completing the DUAE shall be submitted, at the request of the contracting authority, only by the bidder ranked I in the rankingintermediary preparation for the completion of the evaluation of the tenders.

These documents are certificates of tax certification regarding the payment of taxes, duties or contributions to the consolidated general budget at the time of presentation of the document. 165 or failure to comply with the provisions of art. 166 par. (2) of the Law no. 98/2016 with subsequent modifications and additionsthe exclusion of the tenderer from this procedure. 3.

Non-compliance with the provisions of art. 167 of the Law no. 98/2016 (leader, associate, third party, subcontractor).

Way of fulfillment: The sole bidder / associated offeror / subcontractor / third party must prove that they do not meet the provisions of art. 167 of the Law no. 98 / 2016.

The way in which powe can demonstrate the fulfillment of the requirement: it will be completed by the economic operators participating in the award procedure, with the information related to their situation, according to the provisions of art. 193 par. (1) of the Law no. 98/2016. The requirement for non-compliance with the situations provided in art. 167 is also addressed to the associates / subcontractors and third party supporters according to art. 170 asmoothly. (1) and art. 183 par. (1) of the Law no. 98 / 2016.

Incorporation into one of the situations provided in art. 167 of the Law no. 98/2016 entails the exclusion of the tenderer in the present proceedings.

The DUAE document is available in electronic format via the online service provided free of charge by the European Commission, available at: https://ec.europa.eu/growth/toolsdatabases/espd/filter

2) If the evaluation committee finds that more than 2 admissible tenders have been submitted / entered into the SEAP equal prices to first-rank bidders, the contracting authority / entity will submit a clarification request regarding the submission of new improved financial proposals(with 2 decimal places) and the economic operators will send their off-line response (unless there are no technical facilities for re-enrollment encrypted in SEAP) in which case the contract will be awarded to the lowest bidder. Deadlines / dates for submission of new financial proposals will be communicated in the request submitted by the contracting authority / entity;the Contractor shall not respond to requests for clarifications made within the time limit set out in Section I of these Instructions to tenderers. The contracting authority will post the answers with questions in SEAP, according to art. 160 par. (3) of the Law no. 98/2016. In accordance with Art. 160 par. (1) of Law 98/2016, as subsequently amended and supplementedthe limitation to which any economic operator interested in participating in the procurement procedure has the right to request clarification or additional information in relation to the awarding documentation is 20 days before the deadline for the submission of tenders. In accordance with Art. 160 par. (2) of Law 98/2016, as amended and supplemented, The Contracting Authority shall determine that the deadline for responding to all requests for clarification / additional information is 11 days before the deadline for submission of tenders; 4) The offer and the accompanying documents shall be submitted online signed with an extended electronic signature, under the sanction of rejection of the offer as unacceptable, based on art. 137 par.
