Project and execution "Modernization of streets in Măcin, Tulcea county" Lot 1 and Lot 2

The town of Macin is located in the northwest of Tulcea county, at the average altitude of 40 m, having the geographical coordinates 44 14 44 degrees north latitude and 28 7 23 degrees eastern longitude. The city of Macin is located at the confluence of the mothe Danube River with the Macin Mountains, near the Old Danube to the west and the Macin Mountains (the Sum of the Pricopan) to the east and northeast. It has direct access from Braila (Smardan ferry crossing point), Galati (IC Bratianu), Tulcea (S87 E87) and Constanta. in figures) Lot 1: 13 578 069, 52 RON, VAT not included, of which:

- the estimated value of the execution of the work: 12 885 187, 96 RON, without VAT,

- the estimated value for the construction site: 308 550, 75 RON, without VAT, for design services (including technical project verification): 296 208, 72 RON, VAT not included,

- estimated value for technical assistance services (during the execution period and for the partscontrolling phases): 88, 122.09 RON, without VAT.

The bidders, the supporting third parties and the subcontractors must not find themselves in the situations stipulated in art. 164, 165, 167 of Law no. 98/2016

The manner by which the fulfillment of the requirement can be demonstrated: It will be completed by the economic operators participating in the award procedure (including any third parties and subcontractorsi) with the information related to their situation.

The supporting documents proving the non-compliance in the situations provided by art. 164, 165 and 167 shall be requested only by the bidder ranked first after applying the award criterion according to art. 196 par. (2) of the Law no. 98 / 2016.

Tenderers with the filing of the DUAE will also present the commitment of the third supporter, theassociation and / or subcontracting agreement as per Notification no. 256 / 8.12.2016 ANAP

In order to fulfill the requirement, the tenderer / associated tenderer / supporter will complete the DUAE - Part IV "Selection Criteria", Section B "Economic and financial capacity".

(a) For the conversion into Lei the average rate for the year shall be used:

- 2015 - 1 EUR = 4, 4450 RON, - 2016 - 1 EUR = 4, 4908 and

- 2017 - 1 EUR = 4, 5681 RON,

(b) For coins other than the euro, it is first converted into euro using the average rate for 2015, 2016 and 2017 published on the site http://ec.europa.eu/budget / contracts_grants / info_contracts / inforeuro / index_en.cfm. In order to convert the euro into RON, the indications under (a) will be followed. Note 4: In order to meet the requirement, the tenderer may benefit from the support of a third party. In this respect, the provisions of art. 182 of the Law no. 98/2016 and art. 48 of H.G. no. 395 / 2016.

Note 5: If the bidder benefitsthe third party will support the DUAE - Part IV "Selection Criteria", Section B "Economic and Financial Capacity". Note 6: If a third party is supported by a third party, the tenderer will submit :

(a) Firm commitment to financial and economic support provided by a supporting third party, in accordance with Form no. 4B.

The bidder interaction with the bidding process will be conducted according to the following rules: To view the awarding documentation loaded in SEAP, economic operators must have uthe program required to view the electronically signed files (the websites of the electronic signature providers). Rules for communication and data transmission: Requests for clarification regarding this tender documentation will exclusively address SEAP in the "Questions" section of the award procedure conducted by electronic means, and the answers to themwill be published in the SEAP in the "Documentation, clarifications and decisions" section of the simplified participation notice. For the submission of the clarification requests regarding the awarding documentation, the economic operators will register in SEAP (www.e-licitatie.ro) as an economic operator according to the provisions of Article 5 paragraph (1) of GD No. 395/2016 and will transmit the requests havingthe Contracting Authority's terms of reference provided for in Art. 160 161 of Law no. 98/2016. For the subsequent posting of bids: The evaluation committee will forward the clarification requests regarding the offer by using the technical facilities available in SEAP (section "Questions"). The evaluation committee will analyze the DUAE in correlation with the requirements established by thethe acquisition data. The evaluation committee will analyze and check each bid in terms of the proposed technical elements and later on in terms of the financial aspects it involves. Upon completion of each of the verification phases set out above, the contracting authority will communicate to each tenderer which was rejected the reasons underlying this-decisions, and the others to proceed to the next stage of verification, observing the provisions of Chapter IV, Section 13 of Law no. 98/2016. Following the completion of each phase of the test mentioned above, the contracting authority will introduce in ESPP result pass / fail, and will open in SEAP session to present supporting documents submitted related DUAEis the bidder on the first place in the interim ranking to complete the bid evaluation, giving a deadline. The economic operators will send the answers to the clarifications and any documents requested during the evaluation of the offers through SEAP (the "Questions" section) in electronic format, signed with the electronic signature, according to Law 455/2001.economic models will observe the works contract model - form no. 11 which they will attach to the signed and stamped technical proposal.
