Lot 9. Materials for sanitary installations - according to the products corresponding to lot 9 of Annex 1 of the specification. 1. Bidders, supporting third parties and subcontractors shall not be in the situations referred to in art. 164, 165, 167 of Law no. 98/2016, respectively art. 177, 178, 180 of Law no. 99 / 2016.

Mode of accomplishment:

DUAE will be completed inaccording to art. 193 par. (1) of the Law no. 98/2016, respectively art. 202 par. (1) of Law 99 / 2016.

The supporting documents proving the fulfillment of the assumed by completing the DUAE shall be submitted, at the request of the contracting authority / entity only by the ranked tenderers, in each lot in the first three places in the interim ranking list at the completion of the evaluationof the tenders, are: - - certificates for the absence of overdue debts, regarding the payment of taxes, duties or contributions to the consolidated general budget (local budget, state budget, etc.) at the time of presentation, - the criminal record of the economic operator and of the members of the management, management or supervisory body of that economic operator or thatwho have the power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / constitutive document, - if necessary, documents demonstrating that the economic operator may benefit from the derogations provided for in art. . 166 par. (2), art. 167 par. (2), art. 171 of Law 98/2016 on Public Procurement, - other edified documentsIf there is no document of the nature mentioned above in the country of origin or the country where the tenderer / third party / subcontractor is established or the documents do not cover all the situations referred to in art. 164, 165 and 167, the contracting authority / entity has the obligation to accept a declaration on its own responsibility or, if in that country nu there are legal provisions regarding the declaration on own responsibility, an authentic declaration given to a notary, an administrative or judicial authority or a professional association with the competence to do so. 2. The way of accomplishing:

The bidders, the supporting third parties and the subcontractors must not find themselves in the situations stipulated in art. 59-60 of the Law no. 98/2016. Mode of accomplishment: Declaration on non-compliance in the situations provided by art. 59-60 of the Law no. 98/2016 will be presented by all participantswith the DUAE submission. (Form 4 will be filled in - Statement on non-compliance with the provisions of Articles 59-60 of Law 98/2016 on public procurement). The persons holding a decision-making function within the contracting authority are the following:

VI.3) Additional information

1) The awarding documentation is displayed in SEAP, sicap-prod.e-licitatie.ro. The DUAE document is available in electronic format via the online service provided byEuropean Commission at https://ec.europa.eu/tools/espd/filterlang=en

2) Given that the contracting authority will sign the framework agreement only with the economic operators located on the site I, II, III, as the case may be, the way of bidding for equal offers will be as follows:

(a) If the evaluation committee finds that they have been submitted / entered into the SEAPmore than 2 admissible tenders with equal scores to the first ranked bidders, the contracting authority will request the submission of new improved financial proposals (with 2 decimals) and the economic operators will send their answer in a closed envelope (unless there are technical facilities re-encryption in SEAP), in which case the framework agreement will be awarded to the first three biddersthe highest score, (b) If the evaluation committee finds that more than two admissible tenders with equal scores have been submitted by the second rank bidders, the way they will be awarded will be made by applying for the submission in closed envelope (unless there are technical facilities for cryptographic re-encryption in SEAP) new improved financial proposals (to 2 decimal places), andeconomic operators will send their response so that the first ranked bidder is not affected, ie the new financial proposal will not be equal to or less than the ranked first place. If the new financial proposal is improved as a result of the request the contracting authority will influence the rankings of the higher places, this will not be taken into account(c) If the evaluation committee finds that more than two admissible tenders with equal scores have been submitted by the third-placed bidders, the margin rating will be made by requesting enclosure in a closed envelope (only if there are no refurbished technical facilities encrypted in SEAP) of a new proposal(2 decimal places) and the economic operators will send their answer, so that the first and second-placed bidders will not be affected, ie the new financial proposal will not be equal to or lower than the ranked I and II . If the new improved financial proposal submitted as a result of the request of the contracting authority will inflatethe ranking of places I and II will not be taken into account, keeping the initial tender submitted to the SEAP in the procedure.

The deadlines / dates of submission of the new financial proposals will be communicated in the request submitted by the contracting authority.
