Supply of multifunctional snowmaking equipment, equipped with work equipment

Purpose of the acquisition "Supply of multifunctional snowmaking equipment equipped with work equipment" consists in the supply of a new multifunctional machine, manufactured in 2019, self-propelled, provided with the following working equipment:
Main Site: The machine willto be delivered to Sinaia, Calea Brasovului no. 14, Prahova county, postal code 106100.
Purpose of the acquisition "Supply of multifunctional snowmobile equipment equipped with working equipment" consists in providing a new multifunctional machine, manufactured in 2019, self-propelled, provided with the following working equipment:
1) plug of articulated snow;
2) earthen cup;
3) pen equipmentnon-slip material for spreading;
4) access platform for working at height;
5) forklift fork;
6) forestry claw.
The machine must provide the contracting authority with the possibility of further equipment with at least the following work attachments: snow bucket, leaf cup, sweepers, snow mill, spray drying liquid, brush rotativa, water tank for washing with high pressure, rotary mower and vegetable chopper with articulated arm.
Total estimated value without VAT: 940 000 RON.
Requirement 1: bidders / third party supporters / subcontractors / associations, as the case may not be can be found in the situations provided in art. 59-60, 164, 165 and 167 of Law no. 98 / 2016.
The bidders / third party supporters / subcontractors / assocthe yachts will complete the corresponding requirements in the DUAE form from the award documentation. The bidders / associations / subcontractors / third party supporters will submit in SEAP with the DUAE and the declaration regarding the non-classification in art. 59-60 of Law 98 / 2016.
The economic operator (leader, associate, third party supporter, subcontractor) will complete the corresponding request in the DUAE form, with related informationis their situation, from the attribution documentation.
Framing in the situation provided in art. 164, 165, 167 of Law no. 98/2016 regarding public procurement attracts the exclusion of the tenderer from the procedure applied for the award of the public procurement contract.of the contracting authority, only by the bidder ranked first at the end of the evaluation of the bids.
These documents may be:
Romanian legal / natural persons:
- certificate of fiscal attestation for legal persons, issued by the MFP or the subordinated subunits that have the creditor status. budget (from this certificate it must be shown that the bidder has no outstanding debts at the time of deposittheir areas),
- certificate of fiscal attestation regarding local taxes and taxes in the case of legal entities, issued by the Local Council (from this certificate it must be shown that the bidder has no outstanding debts at the time of their submission),
- the criminal record of the economic operator and of the members of the administrative, management or supervisory body of the respective operatoreconomic r or of those who have power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / the constitutive act.
Foreign legal / natural persons:
- edifying documents, issued by competent authorities from the country in which they are residents, through which to prove the fulfillment of the outstanding obligations to pay taxes tothe state budget and the local budget, in accordance with the legislation of the country of residence.
The documents will be presented accompanied by their authorized translation into Romanian,
- as the case may be, documents proving that the economic operator can benefit from the derogations provided in art. 166 para. (2), art. 167 para. (2), art. 171 of Law no. 98/2016 regarding public procurement,
- duas the case may be, other edifying documents.
Requirement 2: single bidders, associate bidders, third party supporters and subcontractors must not be found in the situations provided in art. 59 and 60 of Law no. 98 / 2016.
The modality by which the fulfillment of the requirement can be demonstrated: the declaration regarding the non-compliance with the provisions of art. 59 and 60 of Law no. 98/2016 (Form no. 10) complthis will be presented together with the DUAE by all the participants in the award procedure (single bidders, associate bidders, third party supporters and subcontractors).

1) If 2 or more offers are classified on the first place, with equal scores, the division will be made taking into account the score obtained by the evaluation factors in descending order of their weights. In the situation where equalityit is maintained, the contracting authority will request new financial proposals in a sealed envelope, in order to split the tenders, in which case the contract will be awarded to the tenderer ranked first after recalculating the scores. Note that this will not affect the top positions in the ranking occupied by the other bidders;
2) To view the award documentation uploaded inSEAP, the economic operators must have a program necessary to view the electronically signed files (this program is available free of charge on the websites of the electronic signature providers);
3) According to the provisions of art. 193 of Law 98/2016, it is mandatory to complete the DUAE for all participants in the procedure (bidders, associate bidders, third parties, subcontractors), followingthat the confirmation documents are presented only by the bidder ranked on the first place at the end of the evaluation of the bids. In the process of evaluating the bids, it will be considered to reject an offer in the situation in which the bidder does not submit DUAE art. 104 paragraph (3) in conjunction with art. 60 of GD 395/2016 and art. 137 para. (2) lit. b) from GD 395/2016;
4) If the extended electronic signature does not appearit is the legal representative / power of attorney of the tenderer, he has the obligation to transmit with the offer and the empowerment of the person who signed the documents of the offer with the extended electronic signature. In this sense, the information related to this person will be specified at the DUAE level in Part II, letter B "Information regarding the representatives of the economic operator";
5) In thatthe day in which the specification requirements, other than those requested by the data sheet, are considered unwritten requirements.
