Requirements.

Unique bidder / associate bidder / subcontractor / the supporting third party must prove that it does not comply with the provisions of art. 164, 165, in conjunction with art. 166 (2) and art. 167 dinLaw no. 98 / 2016.

Fulfillment mode: the single bidder / the associated bidder / the subcontractor / third party will complete the DUAE "Reasons for exclusion" section A "Reasons regarding the criminal convictions", section B "Reasons related to the payment of taxes or contributions to insurance social "and section C" Reasons related to insolvency, conflicts of interest or professional misconduct ".

The single bidder / the associated bidder / the subcontractor / the third party supporter must not be found in the situations provided in art. 164, 165, in conjunction with art. 166 (2) and art. 167 of Law no. 98 / 2016.

Their classification in a situation provided for in the aforementioned articles, attracts the exclusion of the bidder from the procedure applied for awarding the public procurement contract.

Alsoa, the bidder ranked first after applying the award criterion, prior to the award of the contract, will present, at the request of the contracting authority, the following building documents proving / confirming the non-classification in the situations provided for in the above articles, for both the single bidder / the associated bidder, as well as for the supporting subcontractor / third party declared in the offera:

1. the criminal record of the economic operator and of the members of the administrative, management or supervisory body of the respective economic operator or of those who have the power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / act constitutive; other edifying documents, as appropriate.

2. A. the three Romanian legal entitiesbuie to present:

- certificate of fiscal attestation regarding the fulfillment of the obligations of payment of taxes, taxes or contributions to the general consolidated budget, from which the lack of outstanding debts at the moment of presenting it;

B. foreign legal persons will present any edifying documents issued by the authorized institutions of the country of origin (certificate of attestation)has fiscal, judicial records, other equivalent documents, etc.) to prove that they have fulfilled their obligations to pay taxes, taxes or contributions to the general consolidated budget, in accordance with the national legislation of the country of residence of the single tenderer / the associate bidder / subcontractor / third party supporter or the country where the single bidder / bidderassociate / subcontractor / third party supporter is established. The building documents presented must show the lack of outstanding debts at the time of their presentation;

3) also, the sole bidder / the associated bidder / the subcontractor / the third party supporter must submit the Form A „Declaration regarding the non-compliance with the provisions of art. 60 paragraph (1) of Law 98/2016 ", according tothe model presented in the "Forms" section. Form A will be compulsorily transmitted with the DUAE, through SEAP and will be signed with the extended electronic signature, based on a qualified certificate, issued by a certification service provider accredited under the law.

Requirement.

The economic operators submitting the offer must prove a form of registration according to the law of the country of residence, to prove that the operator is legally constituted, as it is not in any of the situations of cancellation of the constitution, as well as fthe ability that has the professional capacity to carry out the activities that are the object of the contract.

Fulfillment mode: in order to demonstrate the fulfillment of the criterion of capacity to exercise the professional activity, the single bidder / the associated bidder / the third party supporter / subcontractor will complete the DUAE "Selection criteria" section A "The ability to meet the requirements".

Offerthe document classified on the first place after applying the award criterion will present, prior to the award of the contract, at the request of the contracting authority, the certifying certificate issued by the Trade Register Office from the territorial court, in its entirety, stating that the tenderer is not in any of the the situations of cancellation of its constitution, as well as the fact that it wouldIt is the professional capacity to carry out the activities that are the object of the contract. management, administrators, board memberse etc.

Note 1: for foreign legal persons, edifying documents proving a form of registration will be presented in accordance with the legal provisions of the country in which the tenderer is established, from which the information requested by the contracting authority will appear. : in the case of an association, documents will be presented for each of the members of the association. To meet themif the requirement is fulfilled, it is sufficient that the object of activity of each member is in accordance with the part of the contract that he / she will perform., it will present the certifying certificate for the third party supporters / subcontractors declared in the DUAE. penfor the fulfillment of the requirement it is sufficient that the object of activity of each third supporter / subcontractor is in accordance with the part of the contract that it will perform. as the first proof of not being included in the exclusion situations;
