"Designation of a contractor for performing repair and maintenance activities on roads and streets on the territory of Pomorie municipality on three lots"
The subject of this public procurement is the repair and maintenance (preventive, current and repair works in emergency situations) on 65, 850 km of municipal roads on the territory of Pomorie municipality and 185, 173-km street road network on the territory of the municipality of Pomorie on three distinct positions. Pomorie - Repair and maintenance (preventive, current, repair and repair works in emergency situations) on streets in the town of Pomorie with a length of 38, 708 km and municipal road № BGS1142 - Pomorie - 1, 600 km. Total length - 40, 308 km
The participant should have a registration in the Central(for lots 1, 2 and 3), and for non-residents - registration in a similar register of the building contractor in the construction category in which the object of the contract falls - second group of constructions, fourth category a Member State of the European Union or another State party to the Agreement on the European Economic Area, in case of merger, the requirement refers to the participant (s) who will carry out the construction activities
Verification: When submitting the tender, the circumstance shall be indicated in EEDOP, Part IV "Selection Criteria", Section A " "of the CTRS entry data stating the web address, authority or service issuing the document, the exact reference to the document or the foreignin accordance with its national law, the entry of the person in the relevant professional register of the State in which he is established, permitting, under the legislation of the State in which the person is established and carrying on his activity, the performance of the works works - object of this public pProcurer: At the signing of the contract, the participant selected for the contractor shall submit a document for registration in the TSRC valid on the date of the conclusion of the contract
The participants in the public procurement shall be insured for the insurance risk "Professional liability of the builder" according to Article 171 of the TDA, with a coverage corresponding to the volume and character of the contract, (the object subject of the order for lots № 1, № 2 and № 3 is the second group, the fourth category of constructions, and the scope of the contract is construction)
Authentication: When submitting the tender, the fact is declared in EEDOP, part IV "Selection Criteria", section B "Economic and Financial Condition", item 5 with indication of sum insured, web address, body or office, issuethe right to refer to the document on the existence of Valid Insurance for Professional Liability under Article 171, paragraph 1 of the Territory Management Act, at the limit of liability under Article 5, paragraph 2 of the Ordinance on the Terms and Procedure for Compulsory Insurance in design and construction or an equivalent document (for non-residents) .The professional activity of the insurance policies must correspondthe subject of the contract (the object subject of the order for lots 1, 2 and 3 is the second group of constructions, the fourth category, and the scope of the contract is construction)
Demonstration: At the conclusion of the contract the participant selected for contractor shall provide a certified copy of a valid insurance policy or equivalent document (for non-residents) as stated in EEDOP, and if the policy expires until the date of signing the contract - and a certified copy of the new policy. The Contracting Authority shall exclude from participation in a procedure for the award of a public procurement a participant, for whom there are circumstances under Art. 54, para. 1, items 1-7 of the Public Procurement Act and Art. 55, para. 1, item 1, 3, 4 and 5 of the Public Procurement Act. Participant for whom there are grounds under Art. 54, para.1 of the Public Procurement Act and the circumstances specified by the Assignor under Art. 55, para. 1 of the Public Procurement Act has the right to provide evidence that it has taken measures that guarantee its reliability, despite the appropriate justification for its removal. Participation in the procedure is not allowed and a participant, to whom the hypothesis of Art. 3, item 8 of the Economic and Financial Law of thewith the companies registered in preferential tax jurisdictions, the persons controlled by them and their actual owners, unless the provision under Art. 4 of the same law. Where the participant is an association which is not registered as an independent legal entity, a copy of a document showing the legal basis for the creation of thenot the merger, as well as the following information in relation to the particular procurement: the rights and obligations of the participants in the grouping; agreeing joint and several liability for the performance of the public procurement contract; the activities that each member of the group will perform.
Changes in the composition of the grouping are not allowed after the deadline for submitting the tender. When in a contractand for the creation of an association there are no clauses guaranteeing the fulfillment of the aforementioned conditions, or the composition of the grouping has changed after the submission of the tender, the participant will be removed from the tender procedure for this tender. Where a participant has indicated that it will use the capacity of third parties to demonstrate compliance with the selection criteria andif any subcontractors are used, a separate EEDOP shall be provided for each of these persons, which shall contain information on the lack of grounds for removal and compliance with the selection criteria. In the case of unions which are not legal entities, the compliance with the selection criteria is evidenced by the participating association and not by each of the persons included in it, except for the relevantregistration, presentation of a certificate or other condition necessary for the fulfillment of the order, according to the requirements of a normative or administrative act and according to the distribution of the participation of the persons in the implementation of the activities provided for in the contract for the formation of the grouping.
