ProThe ect envisages the rehabilitation of the road infrastructure, on the new public transport route that crosses the city from east to west, through the city center, to make public transport more efficient and to provide a fast and sustainable transport route with electric vehicles, for the citizens of the city. There are also dedicated and / or priority routes for public transport vehicles, mocompletion of existing public transport stations, bicycle lanes and pedestrian routes.

Main Site: Bistrița Municipality.

The proposed works are:

- works to remodel the geometrical elements of the streets and consist of:

- - dedicated lanes / priority of public transport;

- construction of tracks for cyclists; - rehabilitation of sidewalks;a new road system at the roadside on some streets;

- public lighting works with remote management system;

- weak current infrastructure works;

- construction of a bus station that will include a garage depot and a traffic management station. ;

- construction work for bus stations: 42 current bus stations and 2 head type bus stations completel.

The number of days up to which clarifications can be requested by economic operators before the deadline for submitting tenders: 15 days.

The contracting authority will respond to all requests for clarifications and / or additional information received from economic operators., in connection with the award documentation, 8 days before the deadline for submission of tenders.

A. Reasone of exclusion: the bidders, the third-party supporters (if any) and the subcontractors (if any) must not find themselves in the situations provided in art. 164, 165, 167 of Law no. 98 / 2016.

The method of fulfillment: the DUAE will be completed in accordance with art. 193 para. (1) of Law no. 98 / 2016.

The supporting documents proving the fulfillment of those assumed by completing the DUAE urit is to be presented, at the request of the contracting authority, only the tenderer ranked first in the intermediate ranking drawn up at the end of the evaluation of the tenders are:

- certifying certificates regarding the lack of outstanding debts regarding the payment of taxes, taxes or contributions to the general consolidated budget (budget local, state budget, etc.) valid at the time of presentationi;

- the criminal record of the economic operator and of the members of the administrative, management or supervisory body of the respective economic operator or of those who have the power of representation, decision or control within it, as it results from the certifying certificate issued of ONRC / the constitutive act;

- as the case may be, documents proving that the economic operatorand it may benefit from the derogations provided in art. 166 para. (2), art. 167 para. (2), art. 171 of the Law 98/2016 on public procurement;

- other supporting documents, as the case may be.

In case, in the country of origin or the country in which the bidder / supporting third party / subcontractor is established, no documents of the nature provided for above are issued above or those documents do not cover all the sitethe actions provided for in art. 164, 165 and 167, the contracting authority has the obligation to accept a declaration on its own responsibility or, if there is no legal provision in the respective country regarding the declaration on its own responsibility, an authentic statement given before a notary, an administrative or judicial authority or a professional association that has competence in this regard;

B.Avoidance of conflict of interest: bidders, third party supporters (if any) and subcontractors (if any) should not be found in the situations provided in art. 60 of Law no. 98 / 2016.

The mode of fulfillment: the way by which the fulfillment of the requirement can be demonstrated: the declaration regarding the failure to comply in the situations provided by art. 60 of Law no. 98/2016 will becompleted, scanned, signed with the electronic signature and submitted by all participants to the procedure (tenderer / associate / third party supporter / subcontractor), once the DUAE has been submitted, filling in Form no. 1.

Warning: informthe documents included in the supporting documents must be valid at the time (date) of their presentation.

Specify the average annual turnover. The average annual turnover for the last 3 three years (2017, 2018, 2019) should be at least 30 000 000 RON. We will present the balance sheet / balance sheet statements / balance sheet, etc., remaining at the discretion of the economic operator to choose the documents thator be presented in support of meeting the requirement.

Notes:

1. If, for objective reasons, duly justified, the economic operator does not have the possibility to present the requested documents, he has the right to prove his economic and financial situation and by presenting other documents that reflect a true image of the economic and financial situation and which to prove itmeeting the minimum requirements;

2. If the financial statements are drawn up in another currency, for the conversion into RON, the average annual RON / other exchange rate communicated by the National Bank of Romania for each year will be taken into account. The DUAE will be presented in accordance with the provisions of art. 193 para. (1) of Law 98 / 2016.

For the cases in which the tenderer is an association of economic operators or for the cases in which the tenderer has subcontractors or third party supporters, each economic operator will be authenticated in the system andwill access the procedure for assigning interest in order to complete the DUAE in the quality in which it was included in the respective procedure (associate, subcontractor, third party supporter).
