The object of the contract is the design and execution of the works for the investment objective "Modernization and rehabilitation of the public utility infrastructure, including soil stabilization works in order to increase the competitiveness of the tourist destinations in the Eforie Sud resort", the following Activities:

Main Site: Efori City(a) Design - Phases DTAC, PT, DDE, technical assistance during the execution of the works,

(b) Execution:

- road infrastructure works,

- works soil stabilization (consolidations),

- landscaping area, roller and bicycle track, urban furniture,

- landscaping worksslicing of parking lots, installation of artesian fountains, realization of street lighting,

- auxiliary works water pipes, construction of cable protection tubes, infrastructure and data transmission.

The project aims at realizing the following components:

- carriageable part : 12.652 sqm,

- soil stabilization by injection with self-priming solutions: length 1 662 m,

- parking lots: 3, 988 sqm,

- track rollers and cyclists: 4, 094 sqm,

- pedestrian promenade and landscaping: 2, 905 sqm,

- green spaces: 6, 146 sqm,

- sidewalks: 10, 397 sqm

of the acquisition is of RON 18, 096, 207.62 without VAT, of which:

- estimated cost of design expenditures including elaboration of documentation for the obtaining of building permits (DTAC), technical drafting (PT)(DDE), technical project verification by certified examiners, technical assistance during the execution of the works: 1 042 587 RON without VAT,

- estimated value of works execution: 17 053 620, 62 RON without VAT.

Requirement 1: Tenderers, third parties and subcontractors should not find themselves in the situations provided for in art. 60, 164, 165, 167 of the lawNo.98 / 2016. The way to demonstrate the fulfillment of the requirement: DUAE (Unique European Documnet for Procurement) will be completed by the economic operators participating in the award procedure with information related to their situation. The supporting documents demonstrating the fulfillment of the undertaken by completing the DUAE (Unique European Procurement Document) are to be presented, -at the request of the contracting authority, only by the tenderer placed on the 1st place in the intermediate rankings drawn up at the end of the evaluation of the tenders. These documents may be: - certificates of absence of overdue debts at the time of presentation regarding the payment of taxes, taxes or contributions to the general consolidated budget (local budget, state budget, etc.) at the moment- the judicial record of the economic operator and of the members of the administrative, management or supervisory body of the economic operator, or of those who have the power of representation, decision or control within the economic operator, as follows from the certificate issued by the ONRC / constitutive act; - as the case may be, documents demonstrating that the workthe economic operator may benefit from the derogations provided for in art. 166 par. (2), art. 167 par. (2), art. 171 of Law 98/2016 on Public Procurement; - other editing documents, as appropriate. Both the subcontractor and the supporting third party complete one distinct DUAE according to the provisions of art. 170 (3) and 183 of Law No 98/2016. The non-compliance statement will be submittedin the provisions of art. 60 together with the DUAE, by all the participants in the award procedure (bidder, associate, subcontractor and third party supporter). Note 1: Non-resident economic operators (foreigners) have the right to present any editorial documents issued by the authorities of the country of origin (certificates, criminal records, other editorial documents) to prove their membership / registration with the authorities of the country concerned; andto prove the fulfillment of the obligations to pay the taxes, taxes and contributions to the state budget. The documents shall be presented in a certified copy or legible copy signed by the legal representative and stamped with the mention in accordance with the original, accompanied by their certified translation in Romanian. Regarding the legal expiration date giventhe foreign bidders will prove the fulfillment of the payment obligations in accordance with the legislation of the country of residence. Note 2: DUAE failure to submit with the offer (including associate / third party) raises rejection as unacceptable. The following documents will be filed together with the DUAE: firm commitment of the third party to supportthe effective manner in which it will materialize its support, the subcontracting agreement and / or the association agreement, as the case may be. Requirement no. 1: Information on the financial situation: The global turnover for the last 3 years (2015, 2016, 2017) should be at least equalthat with 34, 000, 000 RON. In order to meet the requirement, the tenderer / associated tenderer / supporter will complete the DUAE - Part IV "Selection Criteria" - Section B "Economic and Financial Capacity". The bidder ranked first after application of the award criterion will present, at the request of the Contracting Authority, the financial statements (balance sheet / final audit reportthe balance sheets for checking if the financial statements for the financial year ended have not yet been finalized) or extracts from the financial statements for the years 2015, 2016 and 2017. These documents will also be presented by the associate tenderer if its resources have been considered to meet the requirement. Note 1: If for objective reasons and jthe economic operator is not in a position to submit the required documents, it is authorized to prove its economic and financial situation by any other document that may be considered appropriate. Note 2: If a group of economic operators submits a joint offer, the requirement is demonstrated by taking into account the resources of all group members. In this situation, -and the associated bidder will complete the DUAE - Part IV "Selection Criteria" - Section B "Economic and Financial Capacity". Note 3: a) For conversion into Lei the average course published on http://ec.europa.eu/budget/inforeuro will be used. For the conversion of the Euro into Lei, the indications under point a will be followed. Note 4: In order to fulfill the requirement, the bidder can benefit fromthe support of a third / third party. In this respect, the provisions of art. 182 of the Law no. 98/2016 and art. 48 of GD no. 395/2016. Note 5: If the tenderer is supported by a third party, the supporting party will complete the DUAE - Part IV "Selection Criteria" - Section B "Economic and Financial Capacity". The contracting authority will reject the third partyproposed if it does not meet the skill requirements, or falls within the grounds for exclusion. Note 6: Documents presented in a language other than Romanian will be accompanied only by authorized translation. 2: Evidence confirming that the bidder will have access at the time of signing the contract, available real debts of debt (such as a credit line or other financial means confirmed by banks) of at least RON 1, 809, 620, sufficient to achieve the cash flow necessary to carry out the activities, which will be exclusively dedicated to the fulfillment of the future contract for a period of maximum 3 months from the date of signing it with the contracting authority, irrespective of other operator's contractual commitmentseconomic. In order to fulfill the requirement, the bidder / offeror partner / third party supporter will complement DUAE - Part IV "selection criteria" Section B "Economic and financial capacity" with information on access to when signing the contract, available real resources unencumbered by debts of at least 1, 809 .620 RON, enough to make the necessary cash-flowwhich will be exclusively dedicated to the fulfillment of the future contract for a period of maximum 3 months from the date of its signing with the contracting authority, independently of other contractual commitments of the economic operator. In the case of the association of several bidders, the requirement of the tenderer's financial capacity can be fulfilled by cumulation by the group of associates. Iin accordance with the provisions of art.182, par. (1) of the Law no. 98/2016 and the provisions of art. 48 paragraph (1), of the H.G. no.395 / 2016 the economic and financial capacity of the tenderer can be sustained, in order to fulfill the contract and by another person (third / third supporters). If the tenderer demonstrates his economic and financial situation by invoking thethe person has the obligation to prove his / her support, as a rule, by presenting a firm commitment of the person, confirming that he will make available to the bidder the financial resources invoked. According to art. 183 of Law no. 98/2016, the person who provides the financial support should not be in the situation that determines the exclusionaward from the award procedure, according to the provisions of art. 164, art. 165 and art. 167 of the Law no. 98/2016. Firm commitment must be a legal instrument that ensures the contracting authority's right to legitimately require the fulfillment of certain obligations by the sponsor, according to art. 182 par. (3) of Law 98/2016 and Art. 48 of H.G. 395/2016. According to pArticle 188 of Law no.98 / 2016, by firm commitment, the third party / third party will be committed to jointly respond to the bidder for the execution of the public procurement contract. The joint and several liability of the third party / supporter / supporter will be committed under the condition of non-fulfillment by the latter of the commitment obligations assumed by the commitment. Documents justifywhich proves the cash-flow fulfillment of the activities assumed by completing the DUAE will be requested by the contracting authority only for the bidder ranked first after finalizing the tender evaluation. The bidder ranked first after finalizing the evaluation of the tenders will present, at the request of the contracting authority, the evidence confirming that he will haveaccess to the moment of signing the contract, available unrecoverable debt resources (such as a credit line, bank deposits or other financial means confirmed by banks) of at least RON 1, 809, 620 for a period of 3 months from the date of its signing with the contracting authority, irrespective of other contractual obligations of the economic operator. For equivalence it will bein view of the average annual lei / currency exchange rate communicated by the NBR. Note: The documents presented in a language other than the Romanian language will be accompanied only by the authorized translation. 1) If there are two or more first-ranked offers with an equal score, the tie-down will be made according to the price.
