Product descriptionyou will be available in the tender specifications of this tender documentation.

To demonstrate the fulfillment of the qualification criteria / requirements, you will be presented:

the sole tenderer / the associated tenderer / the subcontractor / the supporting party must prove that they do not meet the provisions of art. 164, 165, 167, paragraph (1) of the Law no. 98/2016 with subsequent modifications and additionsthe sole bidder / associated bidder / subcontractor / third party will complete the DUAE Part III "Exclusion Reasons" Section A "Reasons for Criminal Offenses, " Section B "Reasons for Paying Taxes or Social Security Contributions" section C "Reasons for insolvency, conflicts of interest or professional misconduct."

Also, the bidderranked first after application of the award criterion on admissible tenders shall present, prior to the award of the contract, at the request of the contracting authority, the following editorial documents proving / confirming non-compliance with the situations stipulated in art. 164, 165, 167, paragraph (1) of the Law no. 98/2016, both for the sole tenderer / associated bidder and the subcontractor(s) stated in the offer:

- The judicial record of the economic operator and of each member of the administrative, management or supervisory body of the economic operator or of the persons having the power to represent, decide or control it, as follows from the certifying certificate issued by the ONRC / Act of incorporation,

- Certificate of Attestationthe scale regarding the payment of taxes, duties or contributions to the consolidated general budget, which would reveal the lack of overdue debts at the moment of presentation. Certificates will be issued indicating the lack of debts related to the payment of taxes, duties or contributions to the general consolidated budget (local budget, state budget, etc.), at the moment prepresentation,

- Certificates / recordings / editorial documents proving / confirming non-compliance in the situations provided by art. 167 par. (1), both for the sole tenderer / associated bidder and for the subcontractor / third party stated in the offer,

- Accredited documents demonstrating that the sole tenderer / associated bidder and the subcontractor / third partyor declared in the offer is in accordance with the provisions of art. 166 par. (2), art. 167 par. (2), art. 171 of Law no. 98/2016 on public procurement (if applicable),

Foreign legal persons shall present any editorial documents issued by the authorized institutions of the country of origin (fiscal attestation, criminal records, equivalent measures, etc.) to prove that he has fulfilled his obligations to pay taxes, duties or contributions to the general consolidated budget in accordance with the national law of the country of residence of the sole tenderer / associated offeror / subcontractor / third party or of the country where the sole tenderer / associated offeror / subcontractor / third partyr is set. From the editorial documents submitted, there must be a lack of overdue debts at the time of their presentation.

The sole tenderer / associated offeror / the subcontractor / third party will submit Form no. 3 "Declaration on the conflict of interest in accordance with the provisions of art. 60 par. (1) of the Law no. 98/2016 on Public Procurement ", as amendedand subsequent additions, in accordance with the template in the "Forms" section of the awarding documentation Form 3 will be submitted with the DUAE obligatorily

The bidder must prove that the total annual average turnover for the last 3 years with the financial year ended was at least 1 650 000.00 RON.

1) Duration of the contract. The duration of the contract is ... months, of which:

- 4 months the delivery period from the date of issue of the pe-mail, sent by the purchaser to the supplier,

- Maximum 105 days, the period of commissioning of the parapet from the moment of receipt of the order. The number of days will be completed when signing the contract, depending on the number of days mentioned in the tender submitted by the contractor, - The warranty period for the products supplied and put into service is at least 24 months from the date of signingand the minutes of reception, in accordance with the provisions of the specifications, a document of this contract. 3) A person who considers himself / herself injured by an act of the contracting authority may seize the Council in order to annul the act of the contracting authority, to oblige it to issue an act or to take remedial measures and to recognize the allegedwithin the period stipulated by the law.

Note 1. The contracting authority recommends to any economic operator interested in the ongoing procurement procedure to submit the clarification / contestation requests regarding the awarding documentation through SEAP by the deadline 4) Estimated value of the contract: 6 746 850, 00 RON, without VAT, broken down as follows:

- Value of products and transport: 5 814 140, 00 RON, without VAT,

- Assembly value: 932 710, 00 RON without VAT.
