Radar Apparatus(1) Bidders, third parties and subcontractors shall not be present in the situations referred to in art. 164, 165, 167 of Law no. 98 / 2016.

- Certificate issued by the Local Public Finance Administration, within the National Agency for Fiscal Administration. The tax certificate must certify that there are no overdue debts related to the payment of taxes, have the contributions to the consolidated general budget at the time of the presentation.

The manner of fulfillment: a legible copy signed and stamped by the legal representative with the mention "according to the original",

- The judicial record of the economic operator and of each member of the administrative, management or supervisory body of that person economic operator or those who have power of representation, decision-making or control within the frameworkas follows from the certifying certificate issued by the ONRC / Act of incorporation, - The manner of accomplishment: a legible copy signed and stamped by the legal representative with the mention "according to the original"; 2) Statement regarding non-compliance with the provisions of Article 58 63 of Law No. 98/2016, completing Form 2, the statement will be dated, signed, stamped and presented oncewith the DUAE, by all participants in the award procedure (bidder, associate, subcontractor or third party). It is required to fill in the separate declaration for each tenderer, associated tenderer, third party, subcontractor (if applicable).

List of persons holding decision-making positions in the concession authority on the organization, conduct and finalization of proceduresand the award is the following:

The way of accomplishing: completing the DUAE by the economic operators participating in the procedure with the information corresponding to their situation

The supporting documents proving the fulfillment of the assumed by the DUAE will be presented at the request of the contracting authority by the tenderer ranked I in the interim ranking made after finalizationevaluation of the offers

The Clinical Orthopedic, Traumatology and TBC Osteoarticular Foisor TB, as the contracting authority, will ask the bidders to submit supporting documents proving the form of registration as a natural or legal person and, as the case may be, attestation or belonging from the point of view in accordance with the provisions of the country in which the tenderer is established(required documents to confirm this information):

Requirement 1.

The economic operators submitting the tender must prove the form of registration under the law of the country of residence, from which it appears that it is legally constituted and is not in any of the sitesthe cancellation of the establishment, as well as the fact that it has the professional capacity to carry out the activities that are the object of the contract.

The DUAE will be filled by the economic operators participating in the award procedure with the information related to their situation. 1) If two or more offers with equal price and the lowest price of the submitted offers are submitted, the bidding (with equal price) by submitting new financial proposals by the tenderers in this situation; 2) The European Unique Acquisition Document will be available for completion by the Operatorinterested economic groups at: https://ec.europa.eu/growth/tools-databases/espd/filter;

3) In order to view the awarding documentation uploaded in SEAP, economic operators must have a required program to view the signed files electronic (websites of electronic signature providers), according to art. 60 par. (4) of GD no. 395/2016; 4) Requests for clarification mentionedhourly presentations of this awarding documentation will be addressed exclusively in the SEAP in the "Questions" section of the award procedure conducted by electronic means, and the responses to them will be published in the SEAP, both in the "Questions" section and in the section "Documentation, clarifications and decisions" in the contract notice, the contracting authority not to give-the course of requests addressed by means of communication other than the established one, according to the provisions of art. 64 par. (1) of the Law no. 98/2016 on public procurement. In order to submit requests for clarifications regarding the awarding documentation, the economic operators will register in SEAP (www.e-licitatie.ro) as an economic operator and as a participant in the award proceduree. For the subsequent submission of tenders, the evaluation committee will forward the requests for clarification regarding the offer by using the technical facilities available in SEAP (section "Questions"). The economic operators will send the answers to the clarifications and any requested documents during the evaluation of the tenders through the SEAP ("Questions" section)in electronic format, signed with the extended electronic signature, according to art. 60 par. (4) of GD no. 395/2016
