Purchase of "Equipment for the proper conduct of the testing activity within the molecular biology laboratory, in the long term, according to the national programs for surveillance and control of diseases co-financed in animals (African swine fever)", respectively:
Main Site: Slobozia locality, Ialomița county.
According to the specifications.
- Statement regarding girlscompliance with the provisions of art. 165, 167 of Law no. 98/2016 completing DUAE,
- Declaration regarding the non-compliance with the provisions of art. 59, 60 of Law 98/2016 completing DUAE,
- The criminal record of the economic operator and of the members of the administrative, management or supervisory body of the economic operator or of those who have power of representation, decision or control within the frameworkl to him, as it results from the certifying certificate issued by the ONRC / the constitutive document,
- presentation of a certificate of fiscal attestation issued by the fiscal administration body of the territorial administrative unit on the basis of which the company has its registered office and the working point / points for which there are obligations of payment, as well as from the local public authorities that attest the lack of debtsarrears to the payment of taxes, taxes, contributions to social insurance, contributions to the unemployment fund (or equivalent for foreign legal persons) at the time of submission the DUAE form will be completed,
- The documents requested above will be presented by the tenderer classified on first place at the request of the contracting authority at the end of the evaluation of the offers,
- In thatthe day in which in the country of origin or in the country in which the candidate is established, documents are not issued that cover all the situations stipulated by the DUAE, a declaration on his own responsibility will be accepted or, if in the respective country there are no legal provisions regarding the declaration on his own responsibility, an authentic statement given in front of a notary, an administrative or judicial authority or athey professional associations that have competence in this regard,
- Documents issued in a language other than Romanian will be presented in the language in which they were issued, accompanied by an authorized translation of these into Romanian. All documents will have, besides the signature, clearly mentioned the full name of the signatory person,
- If the offer is submitted by an association, each associate (s)including the leader) will present DUAE, In case the person who signs the requested statements / forms is not the legal representative of the bidder (leader, associate), a Form 2 power of attorney will be attached to it. According to art. 63 paragraph (1) of Law 98/2016 the persons with decision-making functions within the contracting authority in connection with or for the award procedure are:

To prove the form of Recordrare that the natural or legal person and the object of the contract must have a correspondent in the CAEN code from the certifying certificate issued by the ONRC within the radius of which the tenderer`s office is located, which will include real and current information at the date of filing the DUAE form. DUAE will be completed, following the supporting documents (ORC certificate or, for foreign operators documentsequivalents), to be presented only by the economic operator ranked first, in the intermediate ranking, until the end of the evaluation. from the technical proposal and / or the financial proposal are confidential, classified or are protated by an intellectual property right according to the applicable law.
2) AC has the right to request in original any document with special regime whose validity is conditioned by the presentation in this form;
3) The documents transmitted by electronic means are applicable the legal provisions regarding the electronic signature (Law no. 455/2001, with the amendments and complsubsequent stages). Thus, the tender documents, the DUAE, the qualification documents, any other supporting documents, as well as, where appropriate, the answers to the clarification requests, are transmitted according to the request of the CA, through SEAP, obligatory signed with the extended electronic signature, based on a qualified certificate, issued by an accredited certification service provider, being considered original documents. The documents issued by the authorized official institutions / bodies must be signed and initialed according to the legal provisions, following the extended electronic signature, based on a qualified certificate, issued by an accredited certification service provider, belonging to the OE to be applied by it on the copy of the respective document;
4) DUAE will be likepaid according to the Instructions presented in Annex no. 1 of the Order of the President of ANAP no. 1017/2019;
5) The personal data requested in the present procedure, are processed according to the provisions of regulation no. 679/2016. The purpose of the processing of personal data is that established by the fulfillment of the obligations established by the legislation on public procurement, and dtheir ugly processing is the period of the procedure, as well as the one following it, according to the normative acts in force, completing forms attached to this document.
