16 pieces track mounted on concrete sleepers (according to delivery schedule No. 2/1/436/2018), as follows:

- 10 pieces of type S60-300-1 / 9-A-- 6 pieces of track type S49-300-1 / 9-A mounted on concrete sleepers - Requirement 1: - The contracting entity will exclude from the procedure the associated bidder / tenderers who are in one or more of the the situations stipulated in art. 177, art. 178 par. (1) and (2) and art. 180 par. (1) of Law 99 / 2016.

Also, no third party / subcontractor should be presentis in any of the situations provided in art. 177, art. 178 par. (1) and (2) and art. 180 par. (1) of Law 99 / 2016.

Information regarding non-compliance with the provisions of art. 177, art. 178 par. (1) and (2) and art. 180 par. (1) of Law 99/2016:

- Statement on own responsibility for non-compliance with the provisions of art. 177 of Law no. 99/2016,

documents demonstrating that the operator economic benefits may benefit from the derogations provided in art. 179 par. (2), art. 180 par. (2), art. 184 of the Law 99/2016 on public procurement, - any document considered as edifying in the country of origin or in the country where the tenderer / candidate is established, such as certificates, criminal records or other equivalent documents issued by the competent authorities of that country. in the country of origin or in the country where the tenderer / candidate is established, no documents of the kindthe above mentioned documents or those documents do not cover all the situations stipulated in art. 177, 178 and 180, the contracting entity accepts a declaration on its own responsibility or, if in that country there are no legal provisions relating to the declaration on its own responsibility, an authenticated statement made before a notary, an administrative or judicial authority or an association-professional who has competence in this respect

The way of accomplishment and the applicability in the procedure:

The DUAE will be filled in by each bidder, associated bidder, third party, subcontractor with the information related to their situation, the supporting documents being presented only at the request of the contracting authority, upon completion of the tender evaluationonly by the bidder placed on the 1st place in the intermediate rankings completed at the evaluation of the bids.

Note:

In the case of a group of economic operators who submit their joint offer, each member of the group has the obligation to submit this statement (each member of the association, as well as each proposed subcontractor and / or third party).

DUAE non-submission with the offerThe following documents will be filed together with the DUAE: firm commitment of the supportive third party, which will show how the support will materialize, the subcontracting agreement and the / or the association agreement, as the case may be. Failure to do so with the DUAE is the basis for the applicantsclarification of any formal inaccuracy of the information contained in the DUAE sections of both the tenderer / candidate and the supporting subcontractor / third party, this being necessary to ensure the proper conduct of the award procedure.

1) An economic operator may take part in the procedure only if he / she is registered in the SEAP, 2) Correspondence and all documents submitted by the economic operators will be in Romanian or accompanied by authorized translation in Romanian;

3) The awarding documentation shall be posted in full within the announcement4) The clarification requests of potential bidders will be addressed exclusively in SEAP, at the "Questions" section of the award procedure conducted by electronic means; ) The answers to the clarification requests will be posted within the "Documentation, clarifications and decisions" section of the announcementpublished on www.e-licitatie.ro. The contracting entity will not respond to the requests addressed by another means of communication; 6) The evaluation committee will submit the clarification requests regarding the tenders submitted to SEAP, in the "Questions" section. evaluation of tenders-through the SEAP (Section "Questions"), in full in the section corresponding to the respective request, in the form of one or more separate signed documents / files signed with an electronic signature; 7) If it is found that the first ranked offers have prices equal, the contracting entity will request (via SEAP, in the "Questions" section) the re-a new financial proposal, only for bidders in this situation, in order to divide the offers and will be declared the winner with the lowest offer. The new financial proposal shall be submitted only after the request of the contracting entity; 8) The return of the participation guarantee shall be made upon request, by filling in the form 4 of the Forms and Modules Section dis documents, in accordance with the provisions of art. 44 of H.G. 394/2016; 9) Quantitative and qualitative reception is made at the beneficiary - delivery condition: D.D.P. - the locations within the Branches of R.C.F. Bucharest, Craiova, Timisoara, Cluj, Brasov, Iasi, Galati;

10) The contracting entity only responds to the clarification requests addressed by the economic operators by the deadline set [art. 29 para. (3) of H.G. no. 394/2017, modified by H.G. no. 419/2018].
