The contracting authority intends to acquire microwave equipment, routers, switches, firewall, power supply systems and air conditioning systems in order to modernize and ensure the evolutionary maintenance of the fixed communications system of the Romanian Border Police for increasing the quality and availability of the communications services provided in Mehedinţi, Satu Mare and Caraş Severin, Suceava, Timiş and Botosani, according to technical specifications and topologiesThe main site: Mehedinţi, Satu Mare, Caraş Severin, Suceava, Timiş and Botoşani counties.
The fixed communications system of PFR ensures at county level the interconnection of all PFR locations, as well as the transport infrastructure for the systems of fixed surveillance and mobile communication systems in the TETRA standard.
The Fixed Communication System of the PFR was implPhare 2003 Expansion of the voice / data communication system at the North-East border in the counties of Botoşani, Suceava, Phare 2004 Extension of the voice / data communication system at the South-West and North-West borders, in the counties of Timiş, Caraş- Severin, Mehedinti, Satu-Mare and Maramures, received in 2010, FFE Modernization of the fixed communications system in Botos Countyyear, received in 2015 as well as through the SISF project.
The Integrated Border Security System, a technical solution implemented and accepted since 2010. The warranty period is concluded for all projects. an online computer system working in centralized architecture based on the Fixed Communication System, through which all territorial structures have access to their own databases stored at the IGPF level. Also, by integrating the Fixed Communication System of the PFR with the Voice Data Communications Network of the MIA, all PFR structures have online access to other national interest databases (population records, passport records, auto theft tracking, general tracking etc.) or intern(SIS, VIS, Interpol, FADO, etc.). The main advantage of this system is that it offers any border guards from any PFR location real time information about traffic at Border Crossing Points and border events (border crossings and offenses)
1) Economic operators participating in the proceeding (including assocsubcontractors, third-party supporters) should not be found in the situations provided by art. 164, art. 165 and art. 167 of the Law no. 98/2016 on Public Procurement.
Way to perform: To demonstrate that this requirement is fulfilled, the economic operators participating in the award procedure will complete the DUAE (Single European Procurement Acquis) with the related information■ The documents to be submitted for the fulfillment of the qualification criterion, at the request of the contracting authority, only by the tenderer ranked first, after applying the award criterion, up to the date of the award report, according to art. 196 par. (2) of the Law no. 98/2016 on public procurement with subsequent amendments and completionst:
(a) Fiscal attestation of payment of taxes, duties or contributions to the general government budget (local budget and state budget) for all workplaces and secondary offices for which it has payment obligations, from which to come lack of outstanding debts at the time of their presentation, (b) Where applicable, documents demonstrating that the operatoreconomic benefits may benefit from the derogations provided for in Art. 166 par. (2), art. 167 par. (2) and art. 171 of Law no. (C) the judicial record of the economic operator and the members of the administrative, management or supervisory body of that economic operator or those having powers of representation, decision-making or control within that economic operator, as evidenced by the certifying certificate issued by the ONRC / Act of incorporation, (d) Other editing documents, as appropriate.
If documents of the type required are not issued in the country of origin or in the country where the economic operator is established or they do not cover all the situations covered by art. 164, art. 165 and art. 167, any document considered edifier issued by aucompetent authorities in that country. In the case of bidders of foreign legal / physical persons, the documents will be transmitted in the language in which they were issued, accompanied by an authorized translation of them in the Romanian language. It is not to be found in the situations provided by art. 164, 165, 167 of Law no. 98/2016 on public procurement: the tenderer / members of the association, the subcontractor / s(2) The economic operators participating in the procedure (including associations, subcontractors, supportive third parties) must not be present in the situations provided by art. 60 of Law no. 98 / 2016.
Means of performance: will be completed with DUAE. In the case of submitting an individual / joint tender that is financially and / or technically-professionally supported by a third party/ third supporters, each supporter has the obligation to demonstrate the fulfillment of the requirement. 63 par. 1) Requests for clarification regarding the documentthe attribution will be transmitted only through SEAP https://sicapprod.e-licitatie.ro by accessing the dedicated section "Questions" in the details of the awarding procedure in progress. As a general rule, during the evaluation, the contracting authority may send requests to tenderers clarifications using the SEAP platform functionality. The bidder's response must bebe uploaded electronically in SEAP in the same section before the deadline set by the contracting authority, signed with an extended electronic signature, based on a qualified certificate, issued by an accredited certification service provider. In any of these cases, the request for clarification by the contracting authority and the bidder's response will be made in writing. If the contracting authority requests a tenderer to clarify and, as the case may be, completes the documents submitted by him / her within the tender and the tenderer fails to submit the required clarifications / completions within the specified deadline or the clarifications / completions submitted are not conclusive, his offer will be considered unacceptable ; 2) If it is found that there are offerswith equal scores ranked first, the contracting authority will request re-submission by submitting improved financial proposals, offline, in closed envelope and sealed at the headquarters of the contracting authority; 3) For information on associations and subcontractors, third parties will be supplemented by DUAE; 4) In the case of an association, an application will be submitted at the time of submitting the tenderrd or a preliminary letter of association mentioning that all associates assume collective and joint responsibility for the fulfillment of the contract, that the association leader is empowered to oblige and receive instructions on behalf of all associates and is liable in its own name and in Name of the Consortium for the fulfillment of the contract, Form no. 5 "Model Agreement dthe association will comply with the provisions of the Fiscal Code throughout the implementation period of the contract;
5) If the tenderer intends to subcontract a part / parts of the contract, the DUAE also includes information on the part of the contract to be possibly subcontracted and will have attached the agreement dis subcontracting. Subcontractors whose capabilities are based on the bidder must also complete the DUAE separately, including all the information mentioned in art. 55 par. (1) lit. a), as well as those in par. (1) lit. b) of Law no. 98/2016 on public procurement, with subsequent modifications and completions, from the point of view of the capacities of the subcontractors on which it is basedthe tenderer in the award procedure concerned. In the case of subcontractors on whose capacity the bidder is not based, the DUAE will contain only the information mentioned in art. 55 par. (1) lit. a) of Law no. 98/2016 on public acquisitions with subsequent modifications and completions; 6) For the information regarding the third party supporters, the DUAE will be filled in. At the time of filing(Form no. 7 "Commitment on technical support-similar experience"), to which shall be annexed the documents submitted to it by the supporting third party (s), out of which the the effective way in which the third party / third party (s) will / will ensure the fulfillment of their commitment to support, in accordance withwith the provisions of art. 182 par. 4 of the Law no. - 7) The contracting authority shall conclude the procurement contract with the tenderer designated as the winner during the validity period of the tenders, but not earlier than 11 days from the date of the communication of the results of the procedure award, togrants the legal term of 10 days for the formulation of possible administrative appeals
