Framework agreement for supply of spare parts for Autovision BEE III road traffic monitoring systems

The contracting authority intends to conclude a framework agreement with tenderers whose tenders will be declared admissible. after applying the award criterion, valid for 24 months from semnation by the last part. The contracting authority will respond clearly and completely to all requests for clarification / additional information, only once, on the 11th day before the deadline for submitting tenders for the clarifications requested within the term specified in section I.3. "Communication", from the data sheet.

Main Site: Timisoara Boulevard no. 10B, sector 6.

Authority ccontracting party intends to purchase spare parts for the video surveillance system of Autovision BEE III road traffic.

Exclusion reasons:

The bidder, the member / members of the association, the subcontractor / subcontractors, the third party / third party supporter (s) should not be found in the situations provided. in art. 60, 164, 165, 167 of Law no. 98/2016. The way it can be demonstratedthe fulfillment of the requirement: the DUAE will be completed by the economic operators participating in the award procedure with the information related to their situation, as well as a declaration on their own responsibility regarding the non-classification in the potentially conflict-of-interest situations provided for in art. 60 of Law no. 98/2016 Form 5.

The supporting documents proving the fulfillment of those assumedcompleted by the DUAE, will be presented, at the request of the contracting authority, by the tenderer ranked first in the intermediate ranking drawn up at the end of the evaluation of the bids. or contributions to the general consolidated budget (local budget, budgetstate etc.), at the time of presentation. The document will be presented only by the head office of the tenderer;

- the criminal record of the economic operator and of the members of the administrative, management or supervisory body of the respective economic operator or of those who have power of representation, decision or control in its framework, as it results from the certifying certificateissued by the ONRC / the constitutive act;

- as the case may be, documents proving that the economic operator can benefit from the derogations provided in art. 166 para. (2), art. 167 para. (2), art. 171 of the Law 98/2016 on public procurement;

- other documents, as the case may be.

Note: You should not find yourself in the situations provided in art. 60, 164, 165 and 167 of Law no. 98/2016: the tenderer, the member / members of the association, the subcontractor / subcontractors, the third party / third party (s).

The Single European Procurement Document (DUAE) will be completedaccording to art. 193 of Law 98/2016 all the documents requested by the contracting authority will be submitted by the tenderer by electronic means in SICAP, signed with the extended electronic signature based on a qualified certificate, according to the law no. 455/2001 republished, regarding the electronic signature.

- documents issued in a language other than the Romanian language will be presented in the language in which they were emise, accompanied by an authorized translation of these into Romanian. All documents will have, besides the signature, clearly mentioned the full name of the signatory person.

Criteria regarding the capacity to exercise the professional activity:

1. The economic operators submitting an offer must prove a form of registration according to the law of the country of residence, to show that the eco operatornomic is legally constituted, that it is not in any of the situations of cancellation of the constitution, as well as the fact that it has the professional capacity to carry out the activities that are the object of the contract. The way in which the requirement can be demonstrated: the DUAE will be completed by the economic operators participating in the award procedure with the information related to their situation.The supporting documents proving the fulfillment of those assumed by completing the DUAE, respectively the certifying certificate issued by the ONRC or, in the case of the foreign bidders, equivalent documents issued in the country of residence, will be presented, at the request of the contracting authority, only by the economic operators who sign the agreement -framework. For foreign legal / natural persons documentions that prove a form of registration / attestation will be presented in an authorized translation into Romanian language. subcontractors / third party supporters. If a group of economic operators submits a common offer, these requirements must be meteach member of the association.

1. Requests for clarification regarding the award documentation will be transmitted only through SEAP, by accessing the dedicated section "Questions". electronic in the same section, inaiIt is the deadline set by the CA, signed with an extended electronic signature, based on a qualified certificate, issued by an accredited certification service provider. If the AC requests a clear bidder. and / or completions of the documents presented by him in the tender, and the tenderer does not submit within the specified term clarification / completion. requested or clarification / compl. transmitterif they are not conclusive, his offer will be considered unacceptable.

2. If it is found that there are allowable offers with equal prices, the AC will request the resumption of the competition by sending improved financial proposals, offline, by e-mail.

3. For information on associations and subcontractors, third party supporters will complete DUAE.

4. In the case of an association, at the momentupon submission of the offer, an agreement or letter of association will be presented stating that all the associates assume the collective and joint responsibility for the fulfillment of the contract, that the leader of the association is empowered to oblige and to receive instructions on behalf of all the associates and is responsible in his own name and in the name of the association for the fulfillment of the contract

5. In casere the tenderer intends to subcontract part / parts of the contract, DUAE also includes information on the part of the contract that will be subcontracted and will have annexed the subcontracting agreement. Subcontr. on whose capacities the bidder is based must complete, in their turn, the DUAE separately, including all the information mentioned in art. 193 para. (1) lit. a), preas well as those in par. (1) lit. b) and c) of Law no. 98/2016, from the perspective of the subcontracting capabilities. on which the tenderer relies in the respective award procedure. In the case of subcontracting. on whose capabilities the bidder is not based, DUAE will only contain the information mentioned in art. 193 para. (1) lit. a) of Law no. 98/2016
