Acquisition of concrete slabs necessary for the rehabilitation of the thermal channels as a result of interventions for repair works in the road and / or the green space - according to the Task Book

Main Site: RADET Central Deposit - Bucharest, Timsoara Boulevard no. 78, sector 6.

Description of the procurement: Achizthe concrete slabs necessary for the rehabilitation of the thermal channels as a result of the interventions for remediation works performed in the road and / or the green space, according to the specification.

The quantities to be purchased are shown in the table in Form no. 12 of the "Forms" section

III.1.1.a) Personal situation of the candidate / tenderer:

Information and formalities necessaryto assess compliance with the above-mentioned requirements

Requirement 1:

Procurers / third parties / subcontractors participating in the procedure must not be in the situations referred to in Art. 177, art. 178 and art. 180 of Law 99 / 2016.

Information and formalities necessary for evaluating if requirements are met:

1) Failure to comply with the provisions of art. 177 of Law 99/2016 - will be filled in DUAE; 2)Failure to comply with the provisions of art. 178 of the Law 99/2016 - the DUAE will be filled in; 3) The non-compliance with the provisions of art. 180 of Law 99/2016 - to complete the DUAE; 4) Non-compliance with the provisions of art. 72 of the Law 99/2016 - it will be completed by the DUAE.

The inclusion in the situation stipulated in art. Article 73 of Law 99/2016 entails the exclusion of the tenderer from the procedure for awarding the sectoral contract. The statementregarding non-compliance with the provisions of art. 73 of the Law no. 99/2016 (Form 1 of the Forms File) will be submitted by all participants with the submission of the DUAE.

The manner of accomplishment: the completion of the evaluation of the tenders, will present the documentswhich justify the fulfillment of those undertaken by completing the DUAE. These documents may be: (a) Statutory certificates of duties, taxes, or contributions to the general government budget (local budget, state budget, etc.) at the time of presentation, b) The judicial record of that economic operator and of those who have the power of representation, of decision(c) where appropriate, documents demonstrating that the economic operator may benefit from the derogations provided for in Art. 179 par. (2), art. 180 par. (2), art. 184 of Law 99/2016; (d) other editing documents, as appropriate. The following will be deposited with the DUAE depositiondocuments: firm commitment of the supportive third party, resulting in the actual manner in which its support, subcontracting agreement (s) or association agreement will materialize, as the case may be. Failure to do so with the DUAE is the basis for requesting clarification of any inaccuracy in the form of the information contained in the DUAE sections of the tenderer, and the supporting subcontractor / third party, this being necessary to ensure the proper conduct of the award procedure. Since the contracting entity will sign the framework agreement only with the first-ranked economic operator, the way of pricing the prices the same will be done as follows:

1) If the evaluation committee finds that following the evaluation of the financial offers more than two ad offersmisleading with equal prices to the first ranked bidders, the contracting entity will submit a clarification request regarding the submission of new improved financial proposals (with 2 decimal places) and the economic operators will send their reply offline (unless there are no technical facilities for re-casting encrypted in SEAP) case in which the contract will be awarded to the first bidder in SEAPthe descending order of the points obtained following the application of the award criterion. The terms / dates of submission of the new financial proposals will be communicated in the request submitted by the contracting entity
