Declaration regarding the non-compliance with the provisions of art. 164, related to the period of 5 years (art.171, paragraph (5), letter a) from the deadline for submission of tenders, art. 165 and art. 167, related to the period of 3 years (art.171, paragraph (5), letter b) from the deadline for submission of tenders, from Law no. 98/2016 regarding public procurement (DUAE Form)

Confirmation documents requested:

a. the criminal record of the economic operator and of the members of the administration, management or supervision body of the respective economic operator, or of those who have the power of representation, decision or control within the frameworkits, as it results from the certifying certificate issued by the ONRC / the constitutive document. The information contained therein must be real / current at the time of presentation. The certifying certificate will be presented original, certified copy or copy according to the original.

B. Fiscal attestation certificate, certified copy "according to the original", signed and stamped by the legal representativeal, issued by the fiscal administration body of the territorial administrative unit within the radius of which the economic operator has its registered office, from which the lack of the outstanding payment obligations to the general consolidated budget, existing at the date of presentation of the certificate;

c. Certificate of fiscal certification for legal persons, regarding local taxes and fees and other bug revenuesof the local copy in the certified copy "in accordance with the original", signed and stamped by the legal representative, from which the lack of the outstanding payment obligations to the local budget, existing at the date of the certificate presentation;

Details: The DUAE form is made available to the bidders in the Documentation section of attribution, in .xml format. This statement is also required for any sub-accountsract. In the case of submitting an offer to the association, each associate has the obligation to demonstrate the fulfillment of the requirement. In the case of submitting an individual / joint offer financially and / or technically-professionally supported by third parties / third party supporters, each sponsor has the obligation to demonstrate the fulfillment of the requirement. Framing in one or more of the situations provided in art. 164, art.165 and art. 167 of Law no. 98/2016 regarding public procurement, attracts the exclusion of the tenderer from the procedure for awarding the contract. If in the country of origin or in the country where the economic operator is established, no documents of the type requested are issued or these do not cover all the situations included in art. 164, art. 165 and art. 167, any document considered is acceptededificatory rat issued by the competent authorities of the respective country. In the case of foreign legal / natural persons bidders the documents will be transmitted in the language in which they were issued, in a certified copy "in accordance with the original", signed and stamped by the legal representative, accompanied by an authorized translation into Romanian. Non-deposit of DUAE with the offer (including for the associate / third partysupporter) draws its rejection as unacceptable. Failure to submit, with the offer of the firm commitment of the supporting third party, from which to show the effective way in which it will materialize its support, or, as the case may be, the subcontracting agreement and / or the association agreement constitute the basis for requesting clarifications for any inadvertent form of information withtrapped in the DUAE sections, both of the bidder / candidate, as well as of the subcontractor / third party supporting, this being necessary to ensure the proper conduct of the award procedure. At the request of the contracting authority, the supporting documents requested above will be submitted in certified copy with the mention "according to the original" by the tenderer classified onfirst place in the intermediate ranking, drawn up at the end of the evaluation of the offers. The answers to the clarifications requested by the economic operators accompanied by questions will be published on SICAP (www.e-licitatie.ro), in an attached document at the participation announcement. The contractual clauses are presented in the model of accountsupply ract. By submitting the offers, the economic operators acquire their content, including the answers to the requests for clarifications, attached to the participation notice, if applicable. How to split the offers with equal prices: if the evaluation commission finds that the admissible offers with the lowest price have equal prices, a new one will be requestedfinancial proposal that will be submitted under the same conditions as the offer. Information about the association: The economic operators have the right to associate with the purpose of submitting the common offer. In such a situation, the association agreement will be presented, which will result in at least the following: - the fact that the associates are jointly and severally responsible for executing the contract; - nominationthe leader of the association; - the communications will be made with the leader of the association; - the payments will be made to the leader of the association; - the part (s) of the contract are to be fulfilled / fulfilled by each associate in part; Each associate will complete DUAE. With the DUAE submission, they will present the association agreement (together with documents attached to the commitment, sent to them by the associates, from whichresults the effective way in which the support will be materialized). The supporting documents proving those assumed in commitments / agreements will be requested only to the tenderer declared the winner, at the request of the contracting authority. If a group of economic operators submit a common offer, then the technical and / or professional capacity or the economic-fi situationThe financial statement is demonstrated by taking into account the resources of all the members of the group. Also, the qualification documents from points III.2.1.a) and III.2.1.b), will be presented by each of the members of the association, and the other qualification documents will be presented for the whole associated group. The technical and financial offer will be presented as a joint document signed by the associate leaderation. The association will be demonstrated by presenting an association agreement. If a joint bid is to be declared a winner, the group members have the obligation to legalize their association before signing the contract.
