Requirement no. 1: The bidders, the supporting third parties and the subcontractors must not find themselves in the situations provided by art. 164, 165 and 167 of Law no. 98/2016-Methodto prove the fulfillment of the requirement: the DUAE will be filled in by the tenderers with the information related to their situation.

The supporting documents proving the fulfillment of the assumed by completing the DUAE are to be presented at the request of the contracting authority only by the first- 10 places in the intermediate rankings completed at the evaluation completionarea of offers. These documents may be: a) certificates of absence of overdue debts in respect of the payment of taxes, duties or contributions to the general consolidated budget (state budget, local budget, etc.) at the moment of presentation; b) the criminal record of the economic operator and to the members of the management, management or supervisory body of that operator(c) where applicable, documents demonstrating that the economic operator can benefit from the following: (a) where the economic operator has the power to represent, by the derogations provided in art. 166 par. (2), art. 167 paragraph (2), art. 171 of Law no. 98/2016; d) other editing documents, -as the case may be.

Documents are also submitted by the associated tenderer, subcontractor and third party supporter. 2: The bidders, the third parties, the subcontractors must observe the Rules for avoiding the conflict of interests provided in art. 60 of Law no. 98/2016 on public procurement. The way in which the fulfillment of the requirement can be demonstrated: Offenders, third partiesthe subcontractors will submit the declaration according to art. 60 of Law no. 98/2016 regarding the public procurement (form F.2), with the submission of the DUAE.

Failure to meet the above requirements is a reason to exclude bidders.

- Empowerment - if applicable, (accompanied by copy after the ID or passport) completed according to the F.4 form, dated, signed and stamped for authenticity,

- proof of the constitution of the participation guarantee;

3) When two or moreand many offers have the same value of the financial proposal and are ranked in the same place, the contracting authority will conclude the framework agreement with all the economic operators ranked on the seats corresponding to the maximum number set in the tender notice; 4) Subsequent contracts will be awarded by resuming the competition in the Electronic Procurement System, with the participation of all signatoriesframework agreement. The assignment of economic operators that have equal prices due to the resumption of competition in SEAP will be made by requesting new improved financial proposals. If after the submission of new improved financial proposals no grading is made, the contracting authority will resume the tieup process. The item being referenced is preunit / batch (product). The award criterion is the "lowest price";
