Based on the framework agreements and the subsequent contracts, the services of "Maintenance and park management will be provided, " squares, green spaces, irrigation systems, playgrounds and canisters, cutting cuttings, pruning and trimming trees from the public domainl to the city of Timisoara on 3 zones (I, II and III) ", as they are imposed in the specifications.

Applicable requirements for each lot offered
The City of Timisoara will bexclude at any time of the procedure for awarding the framework agreement for services, any economic operator that is in one of the situations provided in art. 60, 164, 165 and 167 of Law 98/2016 on public procurement.
The reasons for exclusion will be applied also in the case of the associates / subcontractors / third-party supporters, as the case may be.as unacceptable, each economic operator participating in the award procedure, (bidder, associate bidder, subcontractor, third party supporter, as the case may be), will present with the bid for each lot offered, DUAE supplemented with the information related to their situation. to be presented for each lot offered, both the declaration on its own responsibility regarding the non-classification in the provisions60 of the Law no. 98/2016 and, as the case may be, the firm commitment of the supporting third party accompanied by documents from which to show the effective way in which its support will materialize, the subcontracting agreement and / or the association agreement.
The supporting documents proving the fulfillment of those assumed by completing the DUAE for each offered lot, will be presented, dat the request of the contracting authority, by the tenderer who is in the first place after applying the award criterion on the admissible tenders related to the respective lot. general consolidated budget (local budget, state budget, etc.) at the momentpresentation entity;
2. the criminal record of the economic operator and of the members of the administration, management or supervision body of the respective economic operator, or of those who have power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / the constitutive act;
3. if applicable, documents proving thatthe economic operator can benefit from the derogations provided in art.166 paragraph (2), art.167 paragraph (2), art.171 of the Law 98/2016 regarding public procurement;
4. other edifying documents, as the case may be. requested will be presented in Romanian / the language in which they were issued accompanied by the translation into Romanian, as the case may be.

1.DUAE related to the award procedure is made available to economic operators, configuredby the contracting authority directly in SEAP. The economic operators will complete the DUAE directly in the SEAP for each lot offered, with the information / answers related to the classification / non-classification in the reasons for exclusion, respectively the fulfillment of the qualification criteria requested by the contracting authority, taking into account the quality in which they participate in the award procedure, respectiv bidder, associate bidder, subcontractor, third party supporter, as the case may be.
2.To view the attached documents, the economic operators must have a program necessary for viewing the electronically signed files. DUAE completed, the declaration regarding the failure to comply with the provisions of art.60 of Law 98/2016, Proposalof the technique, Financial proposal, supporting document regarding the establishment of the participation guarantee and, if applicable, the Commitment to support the third party, the association and / or subcontracting agreements and the DUAE related to them), only in electronic format, signed with the extended electronic signature and only until the date and time the deadline set for submitting tenders in the particle noticeit seems.
4. The requests for clarifications regarding the present award documentation, will be addressed exclusively in SEAP in the award procedure carried out by electronic means, the contracting authority will not respond to the requests addressed by another communication method than the established one. . Any interested economic operator has the right to request clarification, or iadditional information regarding doc. of awarding, in compliance with the deadline specified by the contracting authority at chapter II.1.4) of this document, respectively no later than 20 days before the deadline established for receiving the offers. Clarifications submitted after this deadline will no longer be considered. According to art.160-161 of Law 98/2016, the contracting authority vto respond clearly and completely to all requests for clarification / additional information, on the 11th day before the deadline set for receiving the offers, to the extent that they will be addressed at least 20 days before the deadline set to receive offers. 5. If the contracting authority requests the presentation of certain clarifications / completions in order to verify the conformity of the offer with the imposed requirements, both the request and the tenderer`s response are transmitted in SEAP, only in electronic format, signed with the extended electronic signature. In the situation in which the tenderer`s response is posted in SEAP without electro signaturenothing extended, its offer will be assimilated to the provisions of art.137 paragraph (2) letter j from GD 395/2016, with the latest additions and modifications, being rejected as unacceptable., will be the offer that meets the highest score from the application of the evaluation factors defined in the award documentation. If following the criterion applicationaccording to its award, two or more economic operators are in the position with the highest score obtained in the process of evaluating the offers, for the distribution, the offer price will be used, in which case the contract will be awarded to the tenderer with the lowest offered price. If two or more op. economic, meet the same score and have the same price offered, the contracting authority will callcites the re-offer of a new financial proposal through SEAP.
