1. Participants in the procedure should not be well foundedtion for removal referred to in Art. 54, para. 1, items 1-7 of the PPA and Art. 55, para. 1, items 1, 4 and item 5 of the Public Procurement Act

National grounds for removal of participants in the procedure are:

- convictions for crimes under Art. 194-208, Art. 213a-217, Art. 219-252 and Art. 254a-255a and Art. 256-260 of the Criminal Code (art. 54, para. 1, item 1 of the Public Procurement Law);

- violations under art. 61, para. 1, Art. 62, para. 1 or 3, Art. 63, para. 1 or 2, Art. 228, para. 3 of CoLabor Code (Art. 54, Para. 1, Item 6 of the Public Procurement Law);

- Violations under Art. 13, para. 1 of the Labor Migration and Labor Mobility Act in force since May 23, 2018 (Art. 54, Para. 1, Item 6 of the Public Procurement Law),

- presence of connectivity within the meaning of para. 2, item 45 of the PD of the PPA between candidates / participants in a specific procedure (Article 107, item 4 of the PPL),

- presence of a circumstance under Art. 3, item 8 of the Economic and Financial Lawis relations with the companies, registered in jurisdictions with preferential tax regime, the persons controlled by them and their real owners,

- circumstances under Art. 69 of the Anti-Corruption and Forfeiture of Illegal Acquisition Act.

In addition to the above grounds, the assignor shall remove from participation on the grounds under Art. 107 of the PPL.

There are no guarantees

Before signing the public procurement contract in accordance with Art. 67, para. 6 of the Public Procurement Act, the contracting authority requires the tenderer designated as a contractor to submit up-to-date documents certifying the absence of grounds for removal from the procedure, as well as compliance with the selection criteria set. Documents shall also be submitted to subcontractors and third parties, if any.
