Operation, maintenance and repair services of the structures and equipment related to the objectives of the hydrotechnical circuit for capturing and evacuation of cooling water from and into the Danube from Units 1 and 2 C.N.E. Cernavoda.

will have the obligation to provide both the necessary staff to carry out the above activities, as well as the spare parts and the necessary materials(at least those specified in Annexes No. 3 and 4 to the Tender Specifications) and the necessary equipments and equipment (at least those specified in Annex 2 of the Tender Specifications), including operator personnel for the respective machinery and equipment

Mode of performance:

All economic operators participating in the procedure (tenderers, associate tenderers, third parties, declared subcontractors) will complete and submit the Declaration on non-compliance with the provisions of art. 72 and 73 of Law no. 99 /2016 (Form III.2.1.a.); 2) The bidder, the associated offeror, the subcontractor, the third supporter must not fit into the situations stipulated in art. 177, 178 and 180 of Law 99 / 2016.

Mode of performance:

- All economic operators participating in the procedure (bidders, associate bidders, third parties, declared subcontractors) will complete the Single Euro Procurement Document- At the request of the contracting entity, the tenderer ranked first after applying the award criterion to the admissible tenders shall present updated supporting documents demonstrating the fulfillment of the requirement, according to the information contained in the DUAE (including related bidders)(if applicable), as follows:

2.1) For Romanian legal / natural persons:

(a) Statutory certificates on the absence of debts in respect of the payment of taxes, duties or contributions to the general consolidated budget local, state budget, etc.) at the time of their presentation,

2 ) Financial support: If the bidder demonstrates his economic and financial capacity by invoking the support given by one or moreyou have a number of third parties, then the tenderer has the obligation to prove to the contracting entity that he has taken all the necessary measures to have at any time access to the necessary resources, presenting a commitment from the third party / third parties. 2.1 ) Requirements for economic and financial capacity and technical and / or professional capacity will be considered to be met by taking into account2.2) If the contracting entity requests the submission of specific authorizations within the criteria regarding the capacity to exercise the professional activity and / or the technical and professional capacity, the requirement is considered fulfilled in the case of the economic operators participating in the common to the award procedure, if they areproving that they have the respective authorized resources and / or that one of the members of the association holds the required authorization, as the case may be, provided that the member executes the part of the contract for which the respective authorization is requested 2.3) If the individual tenderer or the operators economic entities participating in the award procedure subcontract part din the framework agreement / sectoral contract to be awarded, the nominated subcontractor will demonstrate the fulfillment of the technical and / or professional capacity requirements as well as the possession of certain specific authorizations requested for the part of the contract that he / she fulfills; an economic operator considers that certain contract terms are unfavorable, the contracting entity will request the contracting entities, before the deadline for the submission of tenders, clarifications / modifications thereof, so that if the contracting entity decides to modify the clauses in question, this information may be published in SEAP and brought to the attention of all interested economic operators, before the submission of tenders; 4) The contracting entity reserves the rightto verify at any time during the course of the procedure the accuracy of the information and evidence provided by the bidders.
