The bidders, the supporting third parties and the subcontractors must not find themselves in the situations stipulated in art. 164, 165, 167 of Law no. 98/2016. The way in which the fulfillment of the requirement can be demonstrated: the DUAE will be completed by the economic operators participating in the ATR procedurewith information about their situation. The winning bidder will submit the statement on his own responsibility that he is not in the situations provided in art. 164, 165, 167 of Law no. 98/2016. The bidders, third parties and subcontractors should not find themselves in potentially conflicting situations, as defined in Art. 60 of Law 98/2016. Modalwhich can demonstrate the fulfillment of the requirement: the DUAE will be completed by the economic operators participating in the award procedure with the information related to their situation. The winning bidder will submit a statement on his own responsibility that he / she does not have members in the board of directors / management or supervisory body and / or has shareholders or associateshusband / wife, relative or cow to the fourth degree included or who are in commercial relations, as provided in art. 60 of Law 98/2016, with persons holding decision-making positions within the contracting authority - form 4. - Deputy Economic and Administrative Director - Timofte CristThe supporting documents proving the fulfillment of the assumed by completing the DUAE are to be presented at the request of the contracting authority only by the first ranked bidder. These documents may be: (a) ) certifying certificates for the lack of overdue debts in respect of taxes, taxes or contributions(b) the criminal record of the economic operator and of the members of the administrative, management or supervisory body of the respective economic operator or those having the power representation, decision-making or control within it, as evidenced by the certifying certificate issued by the ONRC / the constitutive act,

(c) other editorial documents, as the case may be.

The economic operators submitting the tender must prove a form of registration under the law of the country of residence, from which it appears that the economic operator is legally constituted, is in any of the situations of cancellation of the establishment, as well as having the professional capacity to carry out the activitieswhich are the object of the contract. The way in which the fulfillment of the requirement can be demonstrated: the DUAE will be filled in by the economic operators participating in the award procedure with the information related to their situation. The supporting documents proving the fulfillment of the undertaken by completing the DUAE are: certificate issued by the ONRC or, in the case of foreign tenderers, documents ecin the country of residence, to be presented, at the request of the contracting authority, only by the first ranked bidder in the intermediate rankings drawn up at the completion of the tender evaluation. The information in the certifying certificate must be valid / valid at the date of its submission. 185 of Law 98 / 2016.
