Purchase Milk, Tea and Others, according to specifications. In accordance with Annex 3 to the following contract proposal and Annex 3 of the tender specifications.

The purchase of "Milk, pea, tea and other" will be made in accordance withof the annexes no. 1 to the specification and Annex no. 1 to the framework agreement proposal

Subsequent contracts will be completed according to necessities and availability, monthly, quarterly or half-yearly.

The largest subsequent contract to be concluded is worth 90 531, 70 RON without VAT.

Statement on nfitting into the situations of art. 164 of Law 98/2016 (the criminal record of the economic operator and of the members of the administrative, management or supervisory body of the respective economic operator, or of those who have the power of representation, decision or control within it, as evidenced by the certifying certificate issued by the ONRC / constitutive act.)

Statement-on non-compliance with Art. 165 of Law 98 / 2016.

Statement regarding the non-compliance in the situations of art. 167 of Law 98 / 2016.

Certificate regarding the lack of debts regarding the payment of taxes, duties or contributions to the consolidated general budget (state budget and local budget) valid at the moment of presentation.

Declaration on own responsibility regarding non-compliancethe positions of art. 59. The tenderer / the candidate / the associated tenderer / the subcontractor / the supporting third party who has members of the board of directors / management or supervisory body and / or has shareholders or associates who are spouse, relative or affin to the grade of the second including those who are in commercial relations, as provided in art. 60, with personwhich has decision-making positions within the contracting authority, is excluded from the award procedure. DUAE will be filled in - the successful tenderer will present the documents.

All bidders are required to submit the commitment of the third party (together with supporting documents to the engagement submitted by third party / third-party supporters)the effective manner in which its / their support will materialize), the association agreement and the subcontracting agreement. The supporting documents proving the commitments assumed in the commitments / agreements will be requested only by the successful tenderer at the request of the contracting authority. Tenderers, third parties and subcontractors should not find themselves in prerequisitesto art. 164, 165 and 167 of Law no. 98 / 2016.

The manner by which the fulfillment of the requirement can be demonstrated: DUAE will be filled by the economic operators participating in the award procedure with the information related to their situation. The supporting documents demonstrating the fulfillment of the undertaken by completing the DUAE shall be submitted, at the request of the contracting authority, only by the tenderer placed on the first place in the intermediate rankings drawn up at the completion of the evaluation of the tenders.

These documents may be:

- founding certificates regarding the lack of overdue debts regarding the payment of taxes, contributions or contributions to the general consolidated budget state, etc.) valid at the time of presentation,

- as the case may be, documents by which the dempoints out that the economic operator may benefit from the derogations provided in art. 166 par. (2), art. 167 par. (2), art. 171 of Public Procurement Law 98/2016, - other editorial documents, as the case may be.

Consideration will be given to the obligation to complete and initially present the IPAE by tenderers / candidates (including associates / subcontractors / thirds supporters) as the first proofnon-compliance in exclusion situations and meeting capacity requirements. The failure of the DUAE with the offer (including the associate / third party supporter) entails rejecting it as unacceptable.
