Delivery of control equipment and accessories

The subject of the contract is delivery of control equipment and accessories. The contract is subdivided into 11 lots, subject to items 1 to 10 representing the supply of equipment and item 11 to the delivery of software according to technical and technical specifications.quantitative specifications detailed in Annex No. 1 to the procurement documents.

1. The contracting authority removes from participation in prthe procedure participant for whom any of the reasons exist:

1.1. has been convicted by an enforced sentence of an offense under Art. 108a, Art. 159a - 159d, Art. 172, Art. 192a, Art. 194 217, Art. 219-252, Art. 253-260, Art. 301-307, Art. 321, 321a and Art. 352-353f of the Penal Code (CC);

1.2. has been convicted by a judgment which has the force of res judicata for a crime similar to those referred to in point 1.1 in another Member State or a third country;.3. there are obligations for taxes and compulsory social security contributions within the meaning of Art. 162, para. 2, item 1 of the Tax and Social Insurance Procedure Code and the interest thereon to the state or the municipality at the registered office of the assignor and the participant, or similar obligations under the legislation of the state in which the participant is established, proved by an effective act of competent organ;

1.4. there isinequality in the cases of art. 44, para. 5 of the Public Procurement Act;

1.5. has been found to: the selection criteria;

1.6. was found with ca punitive decree or court decision, violation of art. 61, para. 1, Art. 62, para. 1 or 3, Art. 63, para. 1 or 2, Art. 118, Art. 128, Art. 228, para. 3, Art. 245 and Art. 301-305 of the Labor Code (LC) or Art. 13, para. 1 of the Labor Migration and Labor Mobility Act (CLMTM) or similar obligations established by an act of a competent authority under state law, inwhich the participant is identified;

1.7. there is a conflict of interest that cannot be resolved.

2. The contracting authority also removes from the procedure:

2.1. a tenderer who does not meet the selection criteria or does not fulfill the other condition set out in the contract notice or in the documentation;

2.2. a tenderer who has submitted an offer that does not meet the pre-announced conditionsthe order;

2.3. a tenderer who has submitted a tender which does not meet the rules and requirements relating to environmental protection, social and labor law, applicable collective agreements and / or provisions of international environmental, social and labor law, which are listed in Annex 10 of the PPA;

2.4. participant who has not submitted the justification under Art. 72, para. 1 of the PAP or whose offer was not accepted in accordance with Art. 72, para. 3-5 of the Public Procurement Act;

2.5. participants who are related persons within the meaning of - 2, item 45 of the Supplementary Provisions of the Public Procurement Act;

2.6. a tenderer who does not qualify for the submission, including form, manner and time limit;

2.7. participant who is registered in a preferential tax jurisdiction or controlled by a person who is registeredeither in a preferential tax jurisdiction or participate in a civil society / consortium in which a company registered in a preferential tax jurisdiction (pursuant to section 3, item 8 of the Law on Economic and Financial Relations with companies incorporated in jurisdictions with preferential tax regime, the entities controlled by them and their beneficial owners (ZIFODREPDRKLDS), unless one of the exceptions under Art. 4 of ZIFODRUPRDLDS;

2.8. a participant who is found to be, on the basis of incorrect data, an exception under Art. 4 of ZIFODREPDRCLDS (according to Article 5, paragraph 1, item 3, item "a" of ZIFODREPDRCLDS);

2.9. A participant in respect of whom any of the acts referred to in Article 69 of the Anti-Corruption Act exist and it takesnot of the illegally acquired property (CACCRP) circumstances.
