1. The subject of the order is the delivery of medical equipmentz unloading, carrying, assembly, installation, commissioning and delivery of the workplace instruction and its implementation.

Contractors who are not subject to exclusion due to lack of grounds for exclusion due to failure to meet the conditions referred to in art. . 24 paragraph 1 point 12 23 of the Act. The Purchaser does not provide mthe possibility of excluding the Contractor based on Art. 24 paragraph 5 of the Act.
II. To confirm that there are no grounds for excluding the Contractor from participation in the proceedings, the Employer requires the submission of the following statements or documents:
1) the Contractor`s declaration made on the basis of Art. 25a section 1 of the Public Procurement Law, regarding the grounds for exclusion from the proceedings, in the form of a uniform European order document EATaccording to Annex No. 4 to the ToR;
2) Information from the National Criminal Record in the scope specified in art. 24 paragraph 1 point 13, 14 and 21 of the Act, issued not earlier than 6 months before the deadline for submission of bids;
3) the Contractor`s statement that he has not issued a final court judgment or the final administrative decision regarding arrears with the payment of taxes, fees or contributions insurance sppecuniary or health or in the event of the issuance of such a judgment or decision documents confirming the payment of these debts together with any interest or fines or the conclusion of a binding agreement on the repayment of these debts;
4) the Contractor`s statement of the lack of a decision against him as a preventive measure prohibiting him from applying for public procurement;
5) Statementnot the Contractor about belonging or not belonging to the same capital group; in the case of belonging to the same capital group, the contractor may submit, together with a statement, documents or information confirming that links with another contractor do not lead to distortion of competition in the proceedings within 3 days of posting information on the website about whichthat in art. 86 section 5 of the Public Procurement Law
VI. If the Contractor has its registered office or place of residence outside the territory of the Republic of Poland, instead of the document referred to in point II (2), it submits information from the relevant register, or in the absence of such a register, another equivalent document issued by the competent judicial or administrative authority of the country, where the Contractor has its registered office or place of residence or placesa person who has information or a document has the place of residence within the scope specified in art. 24 paragraph 1 item 13, 14 and 21 of the Act.
VII. If in the country in which the Contractor has its registered office or place of residence or place of residence there is a person to whom the document relates, the document referred to in point VI does not appear, it shall be replaced by a document containing the Contractor`s statement indicatingm of a person or persons authorized to represent it or a statement of the person whom the document was to concern, submitted to a notary public or before a judicial, administrative or professional or economic self-government body competent for the seat or place of residence of the Contractor or place of residence of that person.
VIII. Contractor based in the territory of the Republic of Poland, in relation toa person residing outside the territory of the Republic of Poland, to whom the document referred to in point II point 2) relates, submits the document referred to in point VI, to the extent specified in art. 24 paragraph 1 item 14 and 21 of the Act. If, in the country in which the person to whom the document was supposed to reside, does not appear such documents, it is replaced by a document containing the person`s declarationbefore a notary or before a judicial, administrative or professional or economic self-government body competent for the place of residence of that person. Documents referred to in item VI, VII, VIII must be issued not earlier than 6 months before the submission deadline. To confirm that the deliveries meet the requirements of the Ordering Party, please submit:
- Materials information; in the case of equivalent solutions,
- statement on equivalent offer (provide documents, i.e. Polish and European approvals, certificates).
