Framework agreement for the provision of medical equipment

The contracting authority intends to purchase medical equipment, in the quantities and with the technical specifications described in the specification for each batch.

Main Site: Romanian Emergency Municipal Hospital.

According to the specifications.

The bidders, third party supportersthe contractors must not find themselves in the situations provided in art. 59, 60, 164, 165, 167 of Law no. 98 / 2016.

The way in which the requirement can be demonstrated: the economic operators participating in the procedure (including any third parties and subcontractors) will complete the corresponding requirements from the award documentation, in the DUAE form, published by the contracting authoritytanta within the attribution documentation.

Framing in the situations provided in art. 164, 165, 167 of Law no. 98/2016 regarding public procurement attracts the exclusion of the tenderer from the procedure applied for awarding the public procurement contract.auctions, only by the bidders ranked 1st in the intermediate ranking prepared at the end of the evaluation of the bids. The requested documents will be transmitted through SEAP, signed with the extended electronic signature. These documents are:

- Certificates confirming the lack of outstanding debts regarding the payment of taxes, taxes or contributions to the general budget consolidat (local budget, state budget, etc.) at the time of presentation,

- the criminal record of the economic operator and of the members of the administrative, management or supervisory body of the respective economic operator or of those who have the power to represent, decide or of control within it, as it results from the certifying certificate issued by the ONRC / the constitutive act,

- as the case may be, docdemonstrations that the economic operator can benefit from the derogations provided in art. 166 para. (2), art. 167 paragraph (2), art. 171 of the law 98/2016 regarding public procurement,

- other edifying documents, as the case may be.

Non-resident (foreign) economic operators have the right to present any edifying documents, issued by the authorities of the country in which they are residing.teeth that prove the fulfillment of the obligations of payment of taxes to the state budget and the local budget, in accordance with the legislation of the country of residence. Certificates must attest to the lack of outstanding debts regarding the payment of taxes and social insurance at the time of their presentation. The documents will be presented with their authorized translation in limba roman.

Also, the bidders, the third-party supporters and the subcontractors must comply with the rules for avoiding the conflict of interests provided in art. 59-60 of Law no. 98/2016 regarding public procurement. The declaration according to art. 60 of Law no. 98/2016 will be presented, at the limit of submission of tenders, together with the DUAE by all participants in the procedure. 1) The economic operators can participate in the procedure only if they are registered in the SICAP;

2) The requests for clarification of the potential bidders will be addressed exclusively in the SICAP section "Requests for clarification / questions / communications "within the award procedure carried out by electronic means. The answers to the clarification requests arewill post in the SICAP to the clarification applicant in the section "Requests for clarification / questions / communications", and to all economic operators under the "List of clarifications, notifications and decisions" of the participation notice published on the website www.e-auction. ro

The evaluation commission will send the requests for clarifications regarding the submitted offers, in the SICAP to the section "Request for clarification / questions / communications ". The economic operators will send the answers to clarifications and the possible documents requested during the evaluation of the offers through SICAP, in full in the section corresponding to the respective request, in the form of one or more distinct documents / files signed with the extended electronic signature;

3) The way of separating the offers: in casein which it is found that the offers ranked on the first place have equal prices, according to art. 138 paragraph (2) of H.G. no. 395/2016, the contracting authority will request clarifications through SICAP, in order to electronically upload by the economic operators in this situation documents containing new prices, in which case the contract will be awarded to the tenderer whose new pfinancial breakdown has the lowest price;

4) Offers submitted to a different address than SICAP will be rejected.
